M RULINGS ON LAND CASES 1AIPORTANT DECISIONS RECENTLY MADE. Sccretnry of Interior Decides Points or Law In Desert and Homestead Cue -Some Decision of In- tcre.it to Un try men. The following Important points in law regarding homestead nnd desert land entries have recently been made by the Secretary of the In terior: , Homesteads. While absence from the land on account of sfaknevs will, under some drcunwtnneajs, be Imkl o.vcusoblo by Uta Derwrtnteiit, if it is accompanied by only short residence, monger im provements and cultivation of the entry, the filial proof will be nj jected. Entries made prior to the act of Aug. 20, 1890 (2G stat. 391) reset tlements made prior thereto and subsequently carried to entry should not be considered in determining the quantity of land an entryman or settler may acquire under the limitation of said act. When one claims the right of en try based upon settlement or resi dence, that residence should be continued until the ontry has been allowed. Temiwrarj' absence on the part of the entryman on account of climatic (softditions has been excused by the DrMirtnvent only whn the circum- HatncaB .ourrounding the entry' clear ly indreate a bona fide intention to maintain a home upon the onto.
