panies, nor at all. The U. S. Gov
ernment give it to the state free on
condition that the state provide for
its reclamation. The state con
tracts with the company for reclam
ation and allows the company a
lien against the laud for the cost of
reclamation as fixed in the contract.
Settlers pay off" that lien and then
the state gives lem deeds to thr
land, upon a showing that they arc
settlers.
3. Originally the state did not
make it clear that residence or cul
tivation would be required, and ad
vertising tbcii issued contained tbc
statement that uo residence was
, necessary. It is true that the res
idence required on Government
bomcftcads is not demanded of
Cary-act settlers, but they must
reside on the land at least 30 dajs,
have a substantial 4-rootn bouse
then and have three-fourths the area
under cultivation, or must reside
there 90 days and have one-eighth
In cultivation. Applicant must be
a resident on tbc land at the time
of proof.

chutes Irrigation & Power Co.

made by next November, except in
cases where water is not yet deliv-
ered to the land. However, the
cxlensiou of time docs not apply
automatically, but only upon prop
er snowing to the State Land
Board. On contracts made since
June 17, 1907, proof of settlement
and cultivation is required to be
made within three years nfter re
clamation if, that be subsequent to
the date of contract.
