This is the story of the ronn
Durham heifer Mollio. orphaned at
the tender age of four months, cos
scttcd at the McCanu homestead, a
maverick on the range, branded
by Adam Kotzman, recovered by
McCann and passed through four
ownerships to a law suit, at the
end of which Kotzman pays $87
costs nnd loses the heifer, val
ued at S45.
Away buck in the early autumn
of 1906 L. H. McCann bought of
Grovcr Caldwell a cow and calf.
In an nccideut soon afterward the
cow . offered the fracture of a limb
and in mercy was slain, ledving the
orphan bossy to be reared nnd
petted about the McCaun home
stead After a time the calf
strayed out on the plain and lived
for several months with a bunch
of other cattle found there. Event
ually she was discovered and taken
back to McCanu's, and the testi
mony adduced at the trial in
Justice Court ran to the effect that
the yearling manifested undis
guised pleasure at getting back
home, accepting the fondling of
the family, frisking to her own stall
in the for end of the stable, even
paying a visit to the neighboring
homesteader, E. A. Criffin, and
there Investigating receptacles
where she had formerly found po
tato parings and similar toothsome
refuse. In short, her behavior
was very different from that of the
ordinary range heifer.
In the course ot time the heifer
passed by purchase successively to
Anton Aunc, J. II. Oueill, Charles
Finley and J. It. Wood. Adam
Kotznau was in town one day last
all and the tnild-cyed heifer, now
grown to a mature .cow, fell under
bit eye. From marks wliMj he
identified as his brand he laid claim
to the animal and stralghway took
her to his home. Wood obtained a
writ of replevin and recovered pos
session of the cow and the suc
cessive owners called upon McCann
to make rood the title be bad con
veytd to them. Thus the matter

the jury brought in a verdict for
McCanu,
Notice of appeal was duly filed
and the matter was to come on for
hearing at the present teim ot Cir
cuit Court In Prinevltlc. A sub'
poena duces tecum was iisued for
Mr. Wood, with special instruc
tion to produce the cow lu court at
the hearing, but It was served on
Sunday and was therefore invalid.
And when the case came on the ap
ieal waa found to be Imperfect and
it was dismissed on motion of At
torney Benson, for the plaintiff.
The cost bond given 'by Kotz
man upon appeal was signed by W
Wurxwcllor and Tom' Baldwin as
sureties, thus insuring the payment
of the $87 taxed by the justice,
which docs not include attorney's
and witness's fees for the defense.
The value of the cow was placed
at Us.
After the action in Prinevllle
leaving the animal in possession
and owncrshipi of Wood, he
promptly sold ttie cow to Butcher
White. Further deponent sayeth
not.
