Weymouth, the present mar shal, being'opposed by Floyd Lob dell, and for the council McMillan, O' Kane and Ilrown bcinc opposed by Caldwell, Sather and Overturf. The meeting of the voters Satur day night was called to order by A I, Goodwillie. Dr. Coc was made chairman, C. M. Weymouth secre tary, and Herbert - McDonald and Paul Kraemer tellers. A. L. Good willie was renominated by acclama tion for mayor. If. O. Minor, for treasurer, was nominated by the secretary casting unanimous ballot for him. For recorder A. H. Grant was named by Ora Poindextcr, T. W. Zimmcrmaun by Ralph Sheldon and J. M. Lawrence by William Howell. Grant's homestead, upon which he will be required to estab lish residence in February, was brought into the question and he withdrew. The ballot resulted in 16 for Zimmermann and 31 for Lawrence, and the latter was de clared the nominee of the conven tion. Floyd Lobdell was proposed by Ora Poindextcr for marshal, and Frank Stroud named C. M. Weymouth. Lobdell got 12 bal lots and Weymouth 38. William Howell proposed that J. Frank Stroud, C. D. Brown and D. McMillan, for the long term, and Hugh O'Kauc and S. C. Cald well, lor short term, be nominated collectively for aldermen, and the motion carried. Then Ora Poiu- dexter asked the approval of the convention for another list of alder men composed of A. C. Lucas, IJ. A. Sather and S. C. Caldwell for long term and Millard Triplett and G. W. Whitsett for short term. This was practically granted when the convention got into a wrangle over rliumeutary questions, the chair was overruled on the point that nominations had closed, and the whole council ticket was thrown open again. A down names were placed in the field for alderman. The first ballot resulted in choice of Stroud and McMillan. The second ballot tied Triplett and Brown with 20 votes each, Caldwell reciving 9 On third ballot Triplett received 2S and Brown 20. These completed the long term nominations. O' Kane and Brown were nominated for the short term and the convention adjourned. At a meeting held in the Pilot Butte office Wednesday evening 35 voters were present and In half alt hour the) nominated without op position the People's ticket at the head of this column. Dr. Merrill was chairman and J. H. Overturf secretary. HOW IT AFFECTS BEND DRAKE -D. I. & I'. CO. CONTROVERSY Statcmcut of Main Point Involved, by Mayor uoouwiiiie rso inter ference with Irrigation. Bis.vo, Or., Dec. 1. (To the Editor) So many misleading state ments have been put in circulation respecting Mr. Drake's efforts to protect his own interests and the interests of all the citizens of the locality, that it may be well to have a short statement of the central facts. Stripped of legal technical ities and reduced to its lowest terms the controversy between A. M Drake and the D. I. & P. Co., so far as it holds any public interest, may be stated as follows: Soon after buying the Drake irri gation interests the D. I. & P. Co. made application for a new seggre gation of some 56,000 acres of arid land to the northward of Bend, the water to reclaim which 1,000 cub ic feet per second was to be di verted from the Deschutes river just below the Bend townsite. At the time of the trausfcr it was under stood this would be done. The contract made with the state of Oregon was for diversion at this point. The agreement lor rights of way over certain of the Drake property contemplated a canal from this point. This insured the pas sage of water past Bend for that segregation at least one-third the volume of the river. It guaranteed permanently sufficient water in the river here for power and logging purposes. Now the D. I. & P. Co., without authority or consent of the state, changes its plan so as to divert the water for this 56.coo.acre segre gation at the present hcadworks of the Pilot Butte canal, three miles above Bend, instead of at the point below Bend which its contract with the state and the interest of Bend citizens require. This would leave the river dry at Betid a condition that is not to be tolerated. On the ground that recent at tempts on the part of the irrigation company to gain water rights up the river do not comply with the law, Mr. Drake today filed notice of water appropriation for power pur poses at the darusite near the old butikhouse on the edge of the Bend townsite, his intention being to put this and other power icon trolled by him along the river to immediate use, in an enterprise for which Mr. Drake has been nego tiating within the past month. This will not in the least interfere with irrigation work as contracted for, but it will add greatly to the industrial development of the country. It should not be forgotten that the company burdened the land of this 56.000.acre segregation with a lien of $1.27 an acre more than for its other segregations, upon the claim that the works would be more expensive because of the ne cessity for building a dam to divert the water below Uend. 1 hat Hen is already in its contract with the btate. There is now no objection by Mr, Drake or anybody else to the building of reclamation works ac cording to contracts duly entered into. Mr, Drake stands ready to give every reasonable aid, including rights of wny, for the construction of such works. As a matter of fact he has laid no straw in the way of it. He is placing obstacles in the way of a diversion that is entirely unauthorized, that not Csutlsutd on page fivt, thlnl column. NO. 37 SCHOOL BONDS WIN $6,500 Authorized by the Taxpayers. NEW BUILDING UNDBR WAY Contract Requires Completion by February 10, When Three Rooms will be Occupied. The third bond election for the Bend school district took place last Tuesday afternoon. Twenty-five votes were nailed, of which 21 were in favor of the bonds. I ;j At the first bond election in Tunc I only a dozen votes were cast, all in favor of issuing bonds to the amount of $3,500. Subsequently it was concluded that more money would be required and an election to vote $5,000 bonds was bcldJ Nineteen votes were cast at this time, all in favor. After the bids for the proposed school building; were received it was found thatj still more money would be needed and a move to authorize bonds toj the amount of $6,500 was started. This culminated in the election last Tuesday afternoon. j The election board was composed of Millard T. Triplett, Charles! W, Merrill and ' James D. Honcymani and the clerk was Herbert Rj" Satchwell. i. Besides voting the $6,500 bond4 the taxpayers decided that they should be sold under subdivision! ' 31 of section 3389 of the B & C code that is, to the state land board or other outsider instead of td Bend people. Bend people can er, 10 per cent for their money so of course would not buy 6 per cent ' bonds. ' The bonds to the amount o( $6,000 will be prepared and sold at once. They will probably bring if premium between $250 and $500. Contractor Jarvis has beguu work on the new schoolhouse and is to have it completed and ready for use by the 10th of February, The contract specifics that in get ting labor and materials for the new building those within the dis trict shall have preference, othci things being equal. Awarded Silver Medal. F. C. Rowlee was up from Red mond Monday and said he hac received certificate from the Lewi and Clark exposition that the disf play of vegetables from the D. I. & P. experiment farm, near Beud had been awarded silver medal. Advertised Letters.
