FRIDAY JUNE 16, 1905 Hurrah for Bend's Fourth of July ! The weather is warming up ami the country drying out, and the demand for light clothes aud soft drinks is growing, The auuual school meeting will take place at the school house next Monday afternoon. A director in place of L. D. Wiest and a clerk in nlace of Dr. Nichol arc to be elected, noiwnincrul land herenfter made, timber and stone ns well ns home stead or desert, must be accom panied by an affidavit that the ap plicant' since April 30, 1890, 1ms not acquired title to and is not now claiming "an amount of laud which, together with that now applied for, will exceed in the aggregate 320 acres." If one now takes 320 acres of desert laud he has no homestead or timber right left. If he takes n full homestead and a full timber claim he has no right o a desert claim. lie is entitled to all three forms of entry, but he cannot take more than 320 acres in all. Before this new ruling it was possible for one to take 480 acecs in all, of uoti mineral laud. The new rule mukes no change respecting mineral laud entries. L. T. North, of llcnd, sold a herd of 76 cattle which he owned in Hie John Day valley for $1,030. They go lo Silver I.ake buyers and are to be delivered and paid for in Jtilv Last fall ho sold 20-odd Meets to the same purchaser. J.- Millson Roberts wheeled in fniiii the Sisters ranch Wednesday and loft yesterday morning for his homestead up the Deschutes. Elmer J Merrill ami Joe Taggart timitiipuntcd Imn to their respective homesteads. Notice. Orrin Miller sells the "Multum in Parvo" self heating sad iron, lie will call on you. Think it over. Merrill Now that the public water scrv ice is about to be started tlie com munity shotlld stand together for measures 16 protect the purity of the supply, The Deschutes river is all right if man will refrain from polluting it, and it must be seen to that he does refrain. This is some thing everybody is interested in. PERSONAL ROAD TAX, An impression prevails to some extent that the laws provide no means whereby a penalty for re fusal to work or pay the personal road tax can be enforced. This is an error. The law makes it the duty of the road supervisor, in case a person subject to the tax shall fail to respond to official notice, to proceed to collect the tax by levy upon and sale ot any property that can be found belonging to the delinquent; and no property is ex empt from such process. If no property can be found, the super visor is directed to bring an action in his own name against the de linquent, aud any judgmen "shall be enfo.ced in the same manner as a judgment for a fine in a criminal action." This means that the de lfuquent may be sent to jail to serve time for the amount of the judgement against him for personal road tax The action cau be brought in justice court. This personal road tax is fixed in the law at two days' labor or $3 in cash. "Each male between 21 and 50 years of, age, except those who are a public charge or are too infirm to perform labor" are sub ject to the tax iu this county. Cheap barley chop at building. An important ruling of the sec retary of the interior has just been promulgated, wtierehy the total amount of non-mineral government land to which one person is entitled is reduced from 480 to 320 acres. That is, it cuts one's laud rights down 160 acres. Heretofore, un der the rulings of the land depart ment, timber land has not been counted iu the 320 acres of "agri cultural aud uot mineral" land which one was entitled to enter. Hereafter it Is to be so counted. The 'secretary's instruction runs, pon consideration of the whole sub ject, the history of the legislation, the evil sought to be remedied, and the remedy applied, and studying the mat ter in the light of well defined rules of construction, the department ianovrof the opinion that the purpose of con Kress in the cited legislation was to apply the rule of limitation to the laud;, disposed of under any .of the land laws, other than those acquired under the raiucral land laws; and in expressing tlie conclusion used the word "agri cultural lands" only in contradistinction frvui mineral lands. .Therefore, all -applications fcrj J.
