on February 24, 1900. Complete state
control is provided.

the bank o f the stream. Hereafter,
the priority o f all rights w ill be deter
mined by the date o f receipt o f an ap
plication in the office o f the state engi
neer. I f the application is defective,
it w ill be returned for correction with
out loeing its priprity.

No right to the use o f water from
the streams o f the state can hereafter
be acquired fo r any purpose without
compliance with law. For intelligent
use and development o f our water re-
sources some central office must be
provided, where a reliable record o f all
water rights ean be found. The di
version o f water without the necessary
permit is made a misdemeanor.
The application should be accompan-
ied by a res o f 93 for examining the
earns, together with tbs additional
fees, depending upon the proposed use,
as follows:
For irrigation, graduated aa follows:
18 cents per acre from 0 to 100 acres;
8 cents per acres from 100 to 1,000
acres; 1 cent per acre for each acre in
excess o f 1,000. For power, graduat
ed as follows:
25 cents per horse
power from 0 to 100; 10 cents per
bone power from 100 to 1,000 ; 6 cents
per horse power in excess o f 1,000.
For any other purposes, including ap
plications by municipaliteis, |5.

year from the date o f application and
be com plated within a reasonable time,
as fixed in the permit, net to exeeed
five years.
I f the wader is applied to the bene
ficial use within tbs time allowed;
proof is taken o f each feet by the d i
vision superintendent and a certificate
issued the applicant by the board « f
control. This certificate is o f the same
form as issued to early appropriate»
upon determination o f their l ights, as
described above.
The aew method o f initiating water
rights may seem cumbersome as com
pared with the old method, bwt it is
worth a ll it costs. Tbs rigid, when
finally granted, is absolutely deter
mined as to alj rights hereafter in iti
ated. It w ill be determined as to all
flie wwrid, after a determination as
above outlined. This deterenination is
amde without cost to the aew appro-
priator.

When a headgate has been law fully
dosed to admit the proper quantity of
water, o r shut entirely, it is a misde
meanor fo r the owner to distort) it.
I f the gate has been wrongfully opened
during the night, the presence o f aaoist-
ure in the ditch in the morning to de
clared te be sufficient evidence to con
vict the earner e f unlawful use.

By this procedure, all error« can be
corrected and, if necessary, further tes
timony taken. Aa soon as possible, an
order is entered by the board, determ
ining the rights. This order is pat in-
to execution at once and later filed with
the Circuit court for confirmation.
If
no appeals are taken, the order is con
firmed. I f the case is not reopened
within six months, the decree becomes
final.
Upon such final determination, water
right certificates are issued in accord
ance with the decree.
These certifi
cates are then recorded in the county
records and bear the same relation to
the water title aa the patent from the
United States does to the land title.
The right o f each user from the stream
or from a large ditch, w ill thus be de
termined. The law makes the grant members, w ill be glad to aaaiat the
to the use o f water for irrigation ap public as far u possible under the new
purtenant to the land irrigated.
