Washington, O ct 29.— The internal
revenue bureau is strongly opposed to
the contention o f the California grape
growers fo r a reversal o f the commit
tee's ruling o f March 25, 1908, .which
inhibits the use o f fortified American
sweet wines in the manufacture o f pro
prietary medieines or compounds.
To
do so, in the opinion o f officials, would
be to violate the law and to deprive the
government o f many millions in reve
nue annually. This would be accom
plished, it is pointed out, by the gen
eral substitution in the manufacture o f
proprietary medicines, etc., o f non
taxable sweet wines, which have been
reinforced by the addition o f a preser
vative acid, o f non taxable grape bran
dy for spirits which are taxed $1.10
per gallon. The purpose o f the law
which does not require a tax to be paid
on grape brandy when used fo r this
specific purpose is said to have been
solely fo r the encouragement o f the
grape and sweet wine industries.
Commissioner Capers has received a
letter from Senator Perkins, o f Cali
fornia, advocating the reversal, and
transmitting a copy o f a resolution re
cently adopted by the Manufacturers’
and Producers’ association o f Califor
nia, and the Trans-Mississippi Com
mercial congress at San Francisco. I t
also urges the reversal o f the objec
tionable ruling.

der, who were convicted last spring o f
conspiracy in connection with land
frauds in the West, w e re , taken under
advisement today by Justice Stafford,
o f the Criminal court o f the D istrict o f
Columbia.
Counsel for the convicted men con
sidered that the verdict was the result
o f a compromise, some o f the jurors
who favored conviction o f all four o f
the* defendants who were tried (Hyde,
Schneider, Benson and Dhnond) voting
to acquit Dimond in exchange fo r the
votes o f the other jurors, who were in
clined to acquit all.
The prosecution asserted thatteom-
promise verdicts were being rendered
daily by juries. The defense charged
that the court had erred in telling the
jury that one o f the defendants might
be convicted o f conspiracy.

A report from Washington to the
effect that President Roosevelt had or
dered the Pacific fleet to proceed to the
Atlantic ocean to participate in the
spring maneuvers, thus temporarily
evacuating the Pacific ocean, has cre
ated a profound impression here. The
newspapers all comment on this action
as an indication that the American
people have confidence in the sinceri
ty o f the protestations o f friendship on
the part o f Japan.
The proposed conference o f the pow
ers interested in the Pacific ocean to
discuss the oriental question is gaining
in popular favor. Every newspaper in
the empire favors the propoeed confer
ence, and it is likely that some offi
cial action w ill be taken soon.
