He held th at the legislature has no right t o license the sale ot in toxica tin g liquors, on the ground that the retail liqu or business has n o legal standing, and that to engage in it is n ot one o f the inherent com m on-law rights o f citizenship, since the business is dangerous to public health, pub lic m orals and public safety. Since this dicision w as given in this case by Judge Artm an, com missioners courts in Indiana have been “ np in the air” regard ing the question ot the granting ot liquor licenses, as w ill be seen trom the lollow in g, taken from the M artinville Dem ocrat: “ The com m issioners of H e n d r i c k s county on M onday granted tw o liquor licenses, one to op era te in Danville, the other in P ittsboro. An appeal w as made t o the com missioners t o deny the license on the ground o f the Artman de cision, but this w a s over-ruled by the board. No rem onstrance had been filed, and thus the com missioners decided there w as no legal ground t o deny the appli cations. In Fountain county on Tuesday the com m issioners denied licenses on the ground that the constitu tion bars their issuance. On M onday in this connty the com m issioners refused t o grant licenses in tw o cases on the grounc^ o f the Artm an de cision. In these cases remon strances had been filed, but the right o f the rem onvtrators to use certain o f the names w as disputed, and to get this ques tion properly before the board w ithdraw al cards had been filed.
