Swingle Murder Trial Evidence.
We append the following additional
evidence from the Klamath Falls Express,
taken in the second trial of Frank
Swingle for the killing of Arthur Langell:
Dr. H. A. Wright—“At the time of
the inquest had a talk with defendant
about the shooting; he said, ‘Arthur
Langell was riding on me with his
hatchet to cut me down; I told him to
stop, stop, but he came right on and I
threw mv pistol right around and fired,
without thinking.”
J. L. Demmer—When Arthur Langell
went in the field on the evening of his
death it was for purpose of fixing the
fence.
Dr. S. Hemenwav—If found on a
wound no blackening of power or pow­
der burn, could not tell positively the
distance of the weapon from body; If
badly burned should say weapon was in
close proximity; grains of unexploded
powder will follow the ball for a distance
of about thirty feet.
Miss L. A. Sauber—Was living with
familv of defendant at time of homicide;
saw Holly Swingle at his home in the
evening after the shooting; questioned
him about the difficulty; beeaid in effect,
in the presence of his sister Ida that,
saw Mr. Langell riding after his father
and supposed his father saw him, that
Mr. Langell was driving the cattle and
his papa told him to stop and he wouldn’t
mind him, so his papa shot him; that
he saw the hatchet fall from the hand ot
Mr. Langell as he fell. Witness testified
he said this while both his father and
mother were gone.
Ida Swingle—On the evening of the
homicide her brother Holly and she
went to milk the cows and they did not
go back in the house where Miss Sauber
was until the return of their parents.

Mr. Swingle was too full for utterance,
while hiB little wife, who had so faith­
fully clung to him through all his trials
and tribulations, now clung to his strong
right arm with a rapture born of the
happiest realization of her heart’s de­
sire. The jury, the spectators and tbe
court trooping people came out behind
them, for the great trial was over.
