standing for acquittal, but finally yield­

penitentiary. As has already been re­
corded the indictment was for robbery
with intent to kill in the sand-bagging of
a Siskiyou mountain section hand named
George Phillips. The young men were
taken to Salem last evening.
Tom Godtrey, convicted of manslaught­
er in the killing of James Smith on Siski-
vou mountain last September, was sen­
tenced to ten years imprisonment and
was taken to the penitentiary Sunday.
