Lumber Rete Case W ill be Re-
opened
Washington, Oot. 15.— W. A.
Wimbish, of Atlanta, who was con-

previous decision in the lumber rate
cases. Wimbish sets forth that this
modification, allowing the roads to
maintain a differentia' on cedar shin­
gles and long timbers requiring
more than one car, will work an in­
justice to the people of Idaho, Utah,
and Wyoming because the railroads
can exact a higher charge on these
products than were in force prior to
November 1,1907, end higher even
the rates which the railroads sought
to establish.

A. Wimbish, of Atlanta, who were
counsel for the lumbermen in the
Pacific Coart cases, have been en­
gaged as special counsel of the In­
terstate Commerce Oommisiou to
represent the Government at St.
Paul, where the Hill and Harriman
railroads have brought suit to pre­
vent enforcement of the decision o f
the commission in all the Northwest
eases. This suit is intended to re­
open the entire case that was thresh­
ed out here last Ileoembor and de­
cided last June. Pending a deter­
mination of this suit, the railroads
will observe the rates that went in­
to effect today,
Destructive Forest Fires.
Robert Moran Drowned.
Alpena, Mich., Oot. 1C.— The
whole of northwestern Michigan is
burning.
The flames have already
swept four counties, and the loss of
life is heavy.
It is believed that if
reports could be obtained the re­
sults of the fires would appear the
most appalling in the history of this
part of the country. Fourteen wo­
men and children are known to
have been burned to death at Metz.
On Monday afternoon the body
of Robert Moran, foreman of the
lumber camp of L. J. Cody on
Lamps creek, was found in the riv­
er along side the dock near the
Woolenmill in Bandon.
Mr. Moran was last seen alive at
the skating rink on Saturday even­
ing which place he left without
giving any explanation
as to
where he was going, and did not
return. It seems that he and his
wife who was at the rink With him,
were to have been entertained by
different parties, and Mrs. Moran
did oot think much about bis ab­
sence until she found he had not
gone with the parties he had intend­
ed to go, whon more extensive i
quiry was mad, and when no tr ace
of him could be found, search about
the river was made, with the result
that his body was found as stated.
A deep gash was cut in his bead, in­
dicating that he had struck a log
or other object, stunning him till he
was unable to help himself. The
bereaved wife has the synupthy of
the entire community.
Detroit, Mich., Oct. 16.— Late this
afternoon the towns reported de­
stroyed by the great forest fires are:
Metz, 200 inhabitants; Millersburg,
the largest town in Presque Isle
county, 800 inabitants; Posen, 200
persons; Pulaski, a hamlet.
A Millersburg dispatch says that
when the Metz refugee train was
ditched through the burning of a
culvert, 17 persons are known to
hare been burned to death.

The 200 persons of Metz boarded
the train to escape to the Cheboy­
gan, the northern terminus of the
road. After the train became de­
railed the fire was sweeping through
the trees parallel to the track at­
tacked the wrecked cars.

smothering smoke the men and wo­
men became separated and dashed
in all directions seeking a place at
which to break through the ring of
flames.
Conductor Kinsville managed to
pass the hot blast, but when he
reached Millersburg was totally
blind.
