Holden, Department ot the Interior, Sir: Referring to tbe circul instructions agents of your office, approved by me on January 29,1904, relative to their duties under the act of February 25, 1885 (23 State., 321), entitled “ An act to prevent unlawful occupancy of the public latids,’’ you are advised that said ciroular is hereby amended and modified as follows: Strike on t from said circulur par agraphs 5 and 6, and insert in lieu thereof the following: It shall be the duty of the speci al agent on receipt of any charge or complaint or upon information being acquired by him from any source, that unlawful inclosure is being maintained by persons or per sons, association, or corporation, to at once procure sufficient data, in cluding a description of lands in closed, with reasonable certainty, not necessarily by metes and bounds, nor by Governmental subdivisions of surveyed land, but only so that the inclosure may be identified and tbe persons guilty of tbe violation, as nearly as may be, and by descrip tion if the name can not, on reason able inquiry, be ascertained, and to at once suon.it such case, with the date thus obtained, to the United States attorny for prosecution. It shall be the duty of the special agent.and he shall be so instructed, to be alert and vigalant to detect tbe existance of unlawful inclosures in his district and to proceed in ac cordance therewith as hereinabove directed, and that be is not to con strue his duties as requiring that, before proceeding in tbe matter of an unlawful inclosure, there must first be filed with him a formal com plaint by some person or persons acquainted with the facta, but it shall bo bis duty, as hereinabove stand, to lake the initiative himself.
