Judge Ask» for Brief» Enjoyed by and Guests at Banquet Held Wednesday Evening After hearing the arguments in the case of Jack Lefevre vs. F. G. Leslie as recorder of the city of Coquille, in Circuit court, Tuesday, Judge Brand gave the attorneys five days in which to file briefs. Grant Corby, city attorney, and John D. Goes, presented citations and authorities to show that the resolu tion adopted by the council and con tract for street lighting payments to the Mt. States Power Co., was not Legislation and therefore not subject to refrendum. Carl M. Mack, attorney for the plaintiff, also quoted authorities to prove that the council’s action was legislative, and contended that the reference in the contract to the fran chise defeated last year, made it in fact a franchise and therefore subject to referendum. The action is a mandamus proceed ing, seeking to compel the city re corder to file the petition asking for a referendum vote, ahd to place the measure on the ballot at the next city election, which will be in November next year, unless a special election is previously held.
