To Harmon Powell, Minnie E. Powell
and J. W. Mclnturff, Trustee, the
above entitled, defendants:
In the Name of the State of Oregon
you are hereby notified that you are
required to appear and answer the
complaint filed against yqu in the
above entitled suit within four weeks
from the date of the first publication
of this summons, to-wit: within four
weeU from the seventh day of Oc­
tober, 1927, and if you fail to appear
and answer said summons on or be­
fore the fourth day of November,
1927, that being the last day of the
time prescribed in the Order of
Publication, judgment-will be taken
against you for want thereof for the
relief demanded in complaint, a suc­
cinct statement of which is as fol­
lows:
(a) A judgment against defend­
ants Harmon Powtel and Minnie E.
Powell and each of them for the sum
of $556.58 and interest thereon at
the rate of ten per cent per ann^m
since the first day of December, 1926;
for an attorney foe of $100.00, for
$6.00 paid for continuation of ab­
stract and for costs and disburse­
ments in thia suit.
(b) For a decree that plaintiff’s
mortgage is a first lien against
premises described in said mortgage;
that said mortgage be foreclosed and
that the real property described in
the mortagage be sold on execution in
the manner provided by law and the
proceeds of said sale be applied
toward the satisfaction of said judg­
ment.
(c) That plaintiff have judgment
against defendants, Harmon Powell,
and his wife, Minnie E. Powell, and
each of them for any deficiency that
may remain after the application of
the proceeds from said sale as here­
inbefore stated and for such other
and additional relief as the Court
may deem meet and equitable.
Service of this summons is made
by publication in pursuance of an or-

Brand, Circuit Judge, of Coos Coun-

directing that service thereof be made
