These notices shall satisfy two separate but related procedural
requirements for activities to be undertaken by the City of North
Powder.
REQUEST FOR RELEASE OF FUNDS
On or about February 18, 2022 the City of North Powder will submit
a request to HUD/Oregon Business Development Department for
the release of Community Development Block Grant Funds under
Oregon Business Development Department (OBDD) for the re-
lease federal Community Development Block Grant funds under
Title I of the Housing and Community Development Act of 1974
(PL 93-383), as amended, to undertake a project known as North
Powder Sewer System Improvements Project for the purpose of:
bringing the City of North Powder into compliance with Oregon
Department of Environmental Quality (DEQ) rules. In order to pro-
vide a reliable wastewater system that meets the Clean Water Act
requirements for treated effluent discharge, the City will need to
upgrade and improve the system.
Generally, the project consists of four elements: (1) construction
of evaporation fountains in one of the City’s wastewater lagoons
and improvements to the existing headworks; (2) construction of an
underground pressure main from the current wastewater treatment
facility to the new evaporation wetland; (3) construction of an 11.5-
acre evaporation wetland on City-owned property directly north of
the treatment facility; and (4) rehabilitation of some of the City’s ex-
isting collection system. The new pressure main and evaporation
wetland system will enable the City to discontinue current surface
water discharge.

FINDING OF NO SIGNIFICANT IMPACT
The City of North Powder has determined that the project will have
no significant impact on the human environment. Therefore, an
Environmental Impact Statement under the National Environmen-
tal Policy Act of 1969 (NEPA) is not required. Additional project in-
formation is contained in the Environmental Review Record (ERR)
on file at City of North Powder, Oregon 635 3rd St, North Powder,
OR 97867 and may be examined or copied 8:30AM to 12:30PM
Monday thru Thursday.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on
the ERR to the North Powder City Recorder, Beth Wendt. All com-
ments received by February 17, 2022 will be considered by the
City of North Powder prior to authorizing submission of a request
for release of funds. Comments should specify which Notice they
are addressing.
ENVIRONMENTAL CERTIFICATION
The City of North Powder certifies to HUD/OBDD that John Frie-
boes in his capacity as Mayor of the City of North Powder con-
sents to accept the jurisdiction of the Federal Courts if an action is
brought to enforce responsibilities in relation to the environmental
review process and that these responsibilities have been satis-
fied. HUD’s and OBDD’s approval of the certification satisfies its
responsibilities under NEPA and related laws and authorities and
allows the City of North Powder to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD/OBDD will accept objections to its release of fund and the
City of North Powder’ certification for a period of fifteen days fol-
lowing the anticipated submission date or its actual receipt of the
request (whichever is later) only if they are on one of the following
bases: (a) the certification was not executed by the Certifying Of-
ficer of the City of North Powder; (b) the City of North Powder has
omitted a step or failed to make a decision or finding required by
HUD regulations at 24 CFR part 58; (c) the grant recipient or oth-
er participants in the development process have committed funds,
incurred costs or undertaken activities not authorized by 24 CFR
Part 58 before approval of a release of funds by HUD/OBDD; or
(d) another Federal agency acting pursuant to 40 CFR Part 1504
has submitted a written finding that the project is unsatisfactory
from the standpoint of environmental quality. Objections must
be prepared and submitted in accordance with the required pro-
cedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to
HUD/OBDD at 775 Summer St. NE, Ste.200, Salem, OR 97301.
Potential objectors should contact HUD/OBDD to verify the actual
last day of the objection period.
