employed upon a per diem basis at
the rate of $5 per day. or. "when
the services may be Improved by con
tinuous employment and upon re

receive pay at the rata or $100 per
month," to be paid ,by the county.
Josephine county was created s
wster district in July, 1 9 1 5 . ana M.
U Opdycke was appointed as water
master or the district on July 12,
1915. The water master, upon re
commendation of myseU a superin
tendent, , was employed upon s
monthly .basis of $100 per month
during that season, and continued
to fulfil the duties of water master
until Octnher 1, 1915, when he was
temporarily suspended until the fol
lowing Irrigation season, commenc
ing the latter part of April, T916
when I Instructed him to commence
his work as water master. During
the Interval rrom October 1 to April,
he received no pay. For the month
or April, 1916, he received $25. He
ceased work in 1916 on October 1st,
and began work In 1917 on 'April 1,
receiving no pay during the period
rrom November 1, 1916. to April 1,
1917.
In 1917, at my request, the water
master continued to perform his
duties as such until Deeember 16,
1917. By letter rrom my office on
December 26, 1917, . I Instructed Mr.
Opdycke not to commence work as
water master until May 1, 1918, un
less notified by my office to the con
trary. It therefore appears that the only
period during the non-lrrlgatlng sea
son that a water master was em
ployed In Josefthlne county was dur
ing November and part of December,
1917, and this was nt my direction.
The reason ror this was because
there was In process 06 preparation
adjudication proceedings In resppct
to the determination or practicably
all the water rights In Josephine
county, and necessity existed roy tha
services or a water master to' ad
vise with and assist water users to
