He was widely known' throughout the state and it was a privilege and pleasure of many to hear him, in hisJ advanced age7 relate the in cidents of his early pioneer life. ' His wife died many years ago and a fiiece; Mary Ann Simpson, came from England shortly after and cared for him until the time of his death.- She is highly re spected and devoted the best of her life to his care and service. Thfl-ni now in controversy w'as r - admitted to probate over a year fljgo nd Miss Simpson, as execu trix hoped tQ' have the business Of the estate settled last Satur day but was prevented by the fil ing of the petition to set aside the will. She had planned to eave at once for her old home in England, where she has not been for many years, but will now re- mam nere until tne contest is settled. Mr. Otchin left an es tate valued at about $34,000. The" petitioft""fiIed by ' Rebecca Tongue sets forth that the value of the estate is greater and that property of the probable value of $33,800 was by the will bequeath ed to Mary Ann Simpson, and that the value of the property willed to the heirs of Thomas II. bngue, deceased, who was a nephew of Mr. Otchin, is $2,000. A portion of the estate valued at $6,500 was given to relatives in England. Rebecca Tongue is a sister of Thomas Otchin, and the owner of a large farm north of this city. She is well advanced in years and well to do financial- She alleges in her petition y. that Miss Simpson has resided with Mr. Otchin since coming here from England, and that up to the day of his death by fraud ulent and deceitful devices and schemes and with ' the intention of inducing him to omit his sister from the will, installed herself into hid confidences by continual. carrying untruthful tales to said deceased concerning his sis ter and the heirs of the late Thomas II. Tongue. The peti tion further charges Miss Simp son with inducing Mr. Otchin to believe that she' Was the only person who had any affection for dim; that his sister and the heirs of Thomas II. Tougue cared noth ing for him and were only wait ing for him 'to die' that they might get his property. Many charges of this and like character are set out fully in the petition and it is claimed that Thomas Otchin thus became pre judiced and his mind inflamed and was unduly influenced in the making of his will. E. B. Tongue and A. E. Reames, a son-in-law of tha late Thomas II. Tongue, appear as attorneys for Rebecca Tongue and ask that the will be set aside and that Mrs. Tongue be permitted to take of her broth- er' property as though he died Intestate. The holiday question will enter materially into the con sideration of this contest, as a petition to set aside a will must be filed within one year from the date of admitting the will to pro bate. More than a year has elapsed but it will be claimed that if the governor has author ity to proclaim holidays by the wholesale, the days' so proclaim ed will nM 'ccur.tcd in Cir.;pt- ing time. The contest will be bitter in the extreme. " The various fami lies involved were, before' the fil ing of the will,- apparently on very intimate terms and since the filing of the' will and particu larly since the petition against the will containing the ugly charges against Miss Simpson, bitter feeling has grown. ' Miss Simpson has ' employed' counsel and declares she w ill ' fight the cause to the bitter end, if for no other purpose than to vindicate herself, She is now past middle 1 1 age, has never married and na3 spent the better part of her life in caring for her aged uncle. Many thought before he died that all his wealth would be left to her and when the will was filed, the distribution of his property was considered equitable. From the petition it appears that it is not so mucK the failure to re ceive a larger portion of the es tate that the sister and heirs of the late Thomas H. Tongue ob ject to, but the indue influence which they claim was used against them. ' The contest has excited more than usual attention and interest in that all ' the parties are well known throughout the state, of high standing and well to do. The charges against Miss Simp son are surprising and she will, of necessity be compelled to fight the proceedings to final determi nation, would she receive full vindication. There are many who will not believe Miss Simp son guilty but think she should have received the entire estate, while on the other hand the peti tioners claim they can substanti ate their charges, and over the alleged misconduct of Miss Simp son they feel aggrieved.
