Toll Road Decision Rerersed. Salem, Or., April 30 Justice Eakia today reversed the judgment of Judge II. Burnett, holding that be committed eiror iu sustaining a demurrer in the case of Tillamook county, appellant, against the Wil son River Road company, respon dent. The court holds that the re lief sought lor is forfeiture of the lease; in other words, to cancel the "Instrument by which defendant holds title so that plaintiff may be restored to its title and possession, aud that this belongs exclusively to equitable remedial jurisdiction. The suit was toannu1 a lease of the Wil son River Toll Road, extending from Gales Creek, Washington county, to some six miles from Til lamook City, between Tillamook county and the road company. The lease was entered into in 1901 for a period of 50 years, providing that the company repair and maintain it aud that defendant hold plaintiff harmless from liability by reason oi accident. Plaintiff alleged that the county court had not properly ad vertised for bids in the leasing of the road aud that the same is uu safe and dangerous to public travel The cause is reversed and remand ed.
