Mr. MiU hell took hia customary neat in
the rear or the ihamUr and waa Irn
mediately aurroundml by other Senators,
wLo shook his hand warmly and gave
him assurance of confidence in hia inno
cence. The welcome was so hearty and
so general that the Senator was nearly
over.'ome, so that when, a tew moments
later, he rime to sMak, his voice waa for
a time almost inaudible and it was tlilfl
cult for him to proceed on account of
emotion.
Mitchell read his statement from

cleared and there was little difficulty in
hearing him throughout the chamber
He had the undivided attention of Bena
tors and visitors throughout his recital.
The Hemitors, almost to a man, faced
uUiut when Mitchell began to speak,
and few of them changed jMmitions until
he cloHcd. The scene was impressive.
At the outset, the Senator declared
that the charges made against him, if
true, unfitted him to occupy his seat in
the Senate. He then detailed the charg
cs and said :
"I assert in the most positive and un
qualified manner that each and every
one of these charges, insofar us they re'
late to or involve me, are absolutely, un
qualifiedly and atrociously false, ami I
here and now indignantly and defiantly
denounce their authors, and each and
everyone of them, and brand them pub
licly as malicious and atrocious liars."
Following this general denial with one
more specific, the Senator spoke as fol
lows
"But I desire to be more specific and
therefore I further deny, in terms the
most absolute anil unqualified which I
am capable of uxing, that I ever, either
in the month of January, l!H)'J, in the
State of Oregon or at any other time or
place, unlaw fully or feloniously, or oth
erwise conspire with Binger Hermann,
then ('omuiiHHioncr of the Land Office,
and 8. A. I), l'uter, Horace G. McKin
ley, U. W. Tarpley, Emma I Watson,
Samuel It. OrniHby, Clark K. Loomis and
William II. Davis, or w ith either or any
of them, or with any crson or persons,
to defraud the United States out of any
part cf its public lands longed either in
township 11 south, range 7 east, in the
State of Oregon, or any other public
lands either in the Stiteof Oregon or
elHcwhcre.

any and all statements by any jmrson or
ersons to the effect that I ever at any
time or place entered into a conspiracy
with all or any of said persons, or they
or any of them, w ith me, to d errand the
United States out of any part of its pub

where, either by false of forged home
stead applications, affidavits or proofs
are almolutcly, unqualified and atroci
ously false, and I defy my detainers and
challenge them to produce any evidence

The Senator said he told l'uter certainly

l'uter, the Senator said, replied that h
thought the eases had been thoroughly
investigated by agents in the field and
reiortod on favorably.
."I had not, of course, the slightest
suspicion." said Senator Mitchell, "t"at

I told Puter I would go up to the Land
Office at once and ascertain the status
of the cases, and asked him to go along
with me. He went with me, first if iv
ing me an abstract of a paiier contain'

and the dates of the alleged sales by
each to Mr. Watson, together with the
amount alleged to have Ih-cii paid by
her for each claim."
Then the Senator attacked Francis J
Ileney, United States District Attorney
at Portland in the prosecution of the
land fraud rases, accusing him of unpro
fessional conduct in the juryrooin and
asserting that subsequent to the convic'
tiona in the land fraud cases, early in
December, and before sentence had been
i mooned, Ileney, "engaged with United
States District Attorney John II. Hall in
representing the government in pnaiecu
tion of laid case, entered into an agree'
ment with the said S. A. D. Puter, Km
ma L. Watson and others included in
said conspiracy; by which they offeree
clemency or leniency of some kind of
character, provided they would, by their
evidence, involve myself, Mr. Hermann
and others in these frauds."
The Senator referred to his long ca
reer In the Senate, and said that not un
til this time had any charges been made
against his integrity, either as a man
member of the bar or member of the
Senate. It may be thought, he said, by
some that he hail violated precedent in
coming to the Senate at this time, bat
he declared: "I am an innocent man
and I have at this stage of the proceed'
inn the same right as any other Sena
tor to come here in defense of my char
acter, which is as dear to me as that of
any other Senator on this floor."
He trusted and believed the time
would come when he could w ith propri
ety demand of the Senate a thorough In-
vestigation of every one of the charges
against him. The Senator said in con
clusion : '
"I have been declared by unproved
charge! to lie unworthy to remain long
er as your associate, and being conscious
of the absolute rectitude of my actions
and of my innocence of all wrong, I have
deemed it not only my right but my
duty to myself and to the members of
this Senate that I should come here and
thus publicly deny all charges which I
know to be absolutely false, and also to
explain publicly the acts upon my part
which I admit and which are now in
voked by the prosecuting officer of the
government, and by a portion of the
public press, as badges of crime."
Mr. Mitchell's statement consumed
about three quarters of an hour. Toward
the close his ' voice was broken and he
was compelled to frequently dry his eye

Senators were visibly affected. When

The Senator then said he thought it
proper be should state precisely what
connections he ever had with Puter and
the lands in question and some of the
circumstances connected with the ac
tions ot the grand jury and the puMica
tion in the press regarding the charges
He said that alout March I or 2, 1U02,
Puter called on him in Wa-hington w ith
a letter of introduction from Hon. F. P
Mays, a prominent attorney of Portland,
Oregon, and for many years the District
Attorney for the Oregon District. Puter
had with him a woman, whom he intro
duced as Mrs. E. L, Watson, a widow
and a citizen of Oregon, who had in
veiled something over $"0 O in 12 home
steads after the entrymen had received
their certificates. The woman had ob
tained the greater part of this money by
mortgaging other lands, secured by
notes coming due. She could not raise
the money to meet these notes nntil she
had received patents for the 12 home
steads she had purchased.
Puter had acted as agent for the wom
an, and she was blaming him, Puter
Bit id, as he had assured her when the
in Washington county for 30 years, and
that there remains a goodly portion of

"Still the legislature is about to stop
us from burning the logs and stumps
just because the e position eople want
visitors to see Mount Hood," he said.
"If we cannot clear our lands what will
the fair do for ns? This country is get
ting to lie a good deal like Russia when
a man can't clear the logs off his place
without first applying: to the county
clerk for a permit. I for one will my
no need to such a law, and let them ar
rest me for burning the trash off mv

Rev. Dixon Dead.
Rev. E. W. Dixon, agd 74 years and
a pioneer, died at Forest Grove last
week Thursday night. He crossed the
plains in the late 50s, and was some
years ago sheriff of this county.
Must Support Her.
A decree was rendered in the circuit
court last week, In the suit ot Sagert vs.
Sagert, and it was decided that Lewis
Sagert must suport his old mother out
of the estate his father left him on the
condition that the son should provide
for the widow as long as she lived. She
asked the court to compel Sagert to
pay her a stated monthly allowance, but
Judge McBride decided she would lie
better off living w ith the son, and told
him that he must treat his mother kind
ly. Mrs. Barbara Galbraith was auth
orized by the court to visit the Sagert
home from time to lime and report as
to how the old Inly waa being used.
In the case of William A. S pence vs.
E. II. Jeter, where a verdict was award
ed the plaintiff for ft, 100, Judice Mc
nruie overruled the motion for a new
trial -n the condition that Seuce ac
cept judgment for t-,100, ks the amount
named in the verdict was considered ex
cessive.
Circuit court then adjourned for the
