The petition for rehearing in the
case of E. I). Hhattuck, appelant, vs.
Harrison It. Kincaid, secretary of
state, respondent, wan deuied. This
is the mandamus suit brought by the
appellaut to compel the respondent,
a aecrtary of state, to audit hi claim
and issue a warrant on the state treas
urer in payment thereof, for salary
an circuit judge of the fourth judicial
district.
This suit was commenced in Judge
Hewitt' court, department No. 2,
circuit court of Marion Jcounty. Up
on the filing of a complaint the court
isud an alternative writ of mandam
un,addressed to the defendant and re
spondent, as asked, to show cause for
uot complying with the plaintifTsde
uiaiids. A general demurrer to the
writ was tiled by the defendant, and
the court ordered a pro forma judg
ment, sustaining the demurrer. The
plaintiff refused to amend or further
plead, and the court ordered the writ
quashed, and gave jqdgment for the
'Icletulant, dismissing the proctvding.
From thin judgment appeal was tak
en to the supreme court. A leng'hy
pinion was r ndercd, in which it
was held that the demurrer should
have been overruled and the case re
manded. A petition for re hearing
wan filed hy the secretary of state's
attorney without bis advice- One
petition, prcptrcj by N. H. Knighi,
wan published before Is'lng riled With
the court. The ctilions were both
overruled.
Secretary Kincaid said today that
he has no further disposition to de
lay the matter further, and It la-ins
