Dermlt of South Sioux City, Neb. Mrs. Derinit, who Is seventy-two years old. was not uwure until ufter the deuth of her husband, u Civil war veteran, that site had been divorced from him. In 1884, the couple hud trouble and separated and Mrs. Der- mil began suit for divorce, llefore Ihe decree wus granted, however, there was a reconciliation, and they begun living together ugain, two more children being born. Mrs. Dermlt did not notify her a t­ torney to cease elTorts to obtuln the divorce, she says, and he went uheud and got It. It Is now held th at the divorce was Illegal without her ap­ pearance or testimony, but attorneys cannot find any way to prove that »lie and iter witnesses were not pres­ ent. The Judge who grunted the divorce and the clerk of the court are now dead. Mrs. Derinit cunnot go into court to have tiie divorce annulled, as her husband would have to be named defendant In th at case. A suit cannot be brought directly against the d istrict court. When Dermlt died In 11)10, Mrs. Derm lt applied to the pension depart­ ment and was then th at the divorce was revealed. The couple lived In Iowa for years and that stnte recog­ nizes u common law m arriage, which their union was a fte r the divorce. T he pension departm ent does not rec­ ognize common law m arriages. Several bills have been Introduced in congress to perm it her name to be placed on the roll of widows entitled to a pension, but none of them has passed. An appeal from the pension board's decision to tiie United S tates Supreme court Is being considered. If Mrs. Dermlt succeeds, she will be entitled to $4,500 hack pension and $30 a month.
