defense of Mark Hmom, held In the
county jail on six indictments for
liquor law violations.
In the answer filed to the notion
of the sheriff to confiscate the Huick
uiitoniomile owned by Broom and
which is alleged to have contnined
liquor, Broom retaliates that the offi
cers had no right to take the car,
that no warrant had been issued, and
that furthermore entrance to a pri
vnte garage was forced in order to get
the car.
This Is In violation of the fourth
amendment of the constitution of the
United States, the defense states,
this amendment holding Inviolate the
house and property of citizens. At
the time of the arrest of broom the
night of .lime 1, tho officers making
the arrest reported that the car was
parked outside.
No liquor wus In tho car 15 minutes
before the arrest and the finding of
tho liquor Is due to the actions of "a
certain Btool pigeon" who placed the
liquor, in the mnchlno for the pur
poso of incriminating Jjrooiu, the an
swer Blatos.
In the application for a change of
veuuo filed today it is stated that
Uroom was not in the stnto in lif-U
when the alleged crimes for which he
wus Indicted took place. A reward of
$100 was offered by District Attorney
Clyde N. Johnston for the arrest of
II room and this caused so much pub
licity that a fair trial In Lane county
Is not possible, the application states.
It is further alleged that (he inflamed
state of the mind of the officera is
indicated by tho fact that it took
elevun of them to mako the arrest and
they were all armed with guns nnd
rifles when one officer could have
ir.ado tho arrest nicely, the applica
tion states.
