John T. Scopes, layton, Tenn., school
teacher charged with violating the
Tennessee law prohibiting teaching
of evolution in the schools.
Barrow and Colby are expected to
lose the case in a spectacular fashion
at first, preparatory to the state
and Vnitcd States supreme courts
passing on the constitutionality of
the law.
Iudley Field Malone, who with
Darrow first volunteered his services,
was delegated to keep the homo fires
burning in New York. With Samuel
Hosensohn of the legal staff of the
Civil Liberties Union, Malone. will en
gage in research, digging up previous
trials of scientists as far back, it
was said, as dalilee, who got into
trouble by announcing that the earth
moved around the sun.
Malone was not chosen as one of
the assistants to John It. Neal, form
er dean of the University of Ten
nessee, it was suggested, because he
was brought up a ltoman Catholic and
because he remarried after a divorce.
Itoth of these circumstances, advis
ers said, might prejudice him with a
jury in Tennessee.
Charles Kvans Hughes, also former t
secretary of state, will be held in j
