OP) Former Justice Mahlon Pitney of the supreme court died her early today. Death occurred In the houra Imme diately after midnight. Justice l'ltney was 00 years of ago and retired from the bcLi li been use of ill health, De cember 81, 1022. Associate Justice Mohlon 1 Titney was forced by illness to retire from the United (States supreme court at the hoighth of his usefulness. Entbu siastic aud tireless In devotion to duty, be unstintlngly drew upon his reserve strength until a seemingly .sound and vigorous constitution was undermined, and the collapse came without warning to hla associates up on tbe bench or the public generally. The stroke fell while he was visit ing Philadelphia to Join with Chief Justice Taft and other member! of the Supreme Court in the rededication : of the room in independence uau where the court had held ita firat sea ' sions. There a blood-clot formed in his brain, but prompt medical atten- dance enabled him to return to Wash I ington. By careful nursing he re 1 tnajned upon the bench through the remainder of the term, few suspect ing his real condition. He delivered three opinions after his affliction, those in attendance attributing his husky voice and thick enunciation to temporary bronchial trouble, instead of semi-paralysis of the vocal chords. Hat Second Stroke. I Hope that he would be sufficiently Testqred during tbe recess to permit him to resume his judicial duties when the court reconvened in October was dissipated by a second stroke in Au gust, 10i!2. Then bis fsmily was ad vised by attending physicisns that the genial justice, widely admired for his ability and kindly disposition, was doomed to forced retirement. Ha re luctantly recognised tbe inevitable, and tendered his resignation to take effect December 31, 1922. He was succeeded upon the bench by Justice Edward T. Banford. Congress promptly authorised bis retirement. Although he bad served u on the supreme bench nearly 11 years he was not eligible for retirement un der the usual regulation because only (II yeaa of age, tbe law contemplat ing active service until the age of seventy.
