Kirk, former special prohibition offieer, was found guilty today on a charge of assault with a dangerous weapon on Lyle Ko:idman, it local hotel employe and wag . fined $5iH). Judge Hamilton in passing sentence rebuked Kirk for becoming intoxicated and irresponsible while employed n an officer, but said lie Would abide by the findings of the jury, which recom mended louiency. Kirk, ' according t the evidence, became intoxicated and while' in such condition tried td ar rest Kimdinan. The latter ran and Kirk fired three shots, one of which struck the young mau in the hand, inflicting ft permanent injury. Kirk was tried twice, the jury in the first case failing to agree.
