We are about to elect one of our fellow-citizens to the exalted poaition of diatrlct attorney. This poaition i second in importance only to that of district judge. The responsibilities of that office are many and varied. Tue district attorney is responsible without question, quibble, or intet ference for Die disbursement of countless thousands of dollars of the taxpayers money, Without his loyal and intelligent co-operation the dis trict judge would be powerless tn properly administer the law. lie is not only the prosecutor of crimes . committed in our midst, but he is nlno the legal advisor of the county couit and each and all of the otbcv county officers and employes. Upon his legal opinion countless thousands of dol lars of the people's money is annually disbursed. Ho is also the connecting link and natural bond of the two great classes of our community tho law abiding and tbe criminal. Hi should have not only a well-trained legal . mind, but he should also be blest wlib a widely known reputation for being as law-abiding as tie is obedient lo the law. Long before announcing himself as a candidate for this highly important position he should be able to exclaim before all men and women . like Aristidea of -old "these bands are clean." She taken no account of sen! mcnt and intention; but in 'her cold and luminous eyes that mnn is right Is to be chosen who is known to hove fought in harmony with the stars in their courses and through whose efforts and struggles the world lias been helped onward, and humanity moved to a higher level and a brighter dor. I am not unmindful of the solemn responsibility resting upon mo because of i..y action in this matter. I am thereto constrained to oppose his election as district attorney and tn transfer ray political alleglauce to Hon, John 8, Medley, whose private and professional llfo and character is well and widely known to be like that of Caesar's wife "above suspicion or reproach." It says: "On April 3, 1015, the district at torney for Lane county filed In the circuit court for such county an af fidavit In tba following language: "'I, Deals Carter, being first duly sworn, say: That I am the wife of one Klsla Carter ond the mother of Moo nclta Carter and Gertrude Carter; that an Information was filed In the office of J, K. Wells, justice of tbe peace for Eugene Justice district. Iane county, Oregon, charging Elzia Carter with crime with and upon Mnn Jielta Carter, who was the dauehter of aaid Elria Carter, and that there- county, Oregon, served affiant aud tbe aaid (ieatrude Carter and Mon- neita Carter with aubpoeuas, com manding the said persona la appear before the grand jury of Lane cou.i tv, tlute of Oregon, on tbe 12th day of October, 11)14. " 'That on the 20th day of Septem ber, Howard M. Brownell, who repre sented himself to me to be the attor ney for Elzia Carter, asked an Inter view with me, and when tbe same was refused, he persisted in talking and requested me at that time to takn tbe said .Monnerta Carter and leive the stale with her so that we would not be here to testify against Eli.a Carter. 1 refused at thut time to comply with his request, aud informed him that wo woro state's witnesses and could not participate in anything of tbe kind, or comply with bis re quest or HiiKgestiou. Thereafter, on the 1st day of October, he cauui to our residence in Harrisburg, Oregon, and urged that I tukc all the children, including Mnuneita Carter, und leave tbe state, lie said that be would i-ee that wo got the money, thut he would sec that I g"t a divorce from Elzia Carter, and that I would be paid (oi) per mouth alimony, and that tb? children would be put in school. '"On Friday night, October 2, be came aguiu to fur place in Harris burg, Oregon, accompanied by Elzia Carter, and persuaded us to leave the atate and go to Seattle, Washington. On that same evening, Elzia Curtcr and Howard M Brownell assisted in preparing the baggage, and assisted in getting it to tbe Oregon Electric station in Harrisburg, and Elzia Car. ter gave Gertrude Carter sufficient money to pay our railroad fares to Portland. Tbat Elzia Carter and How ard M. Brownell accompanied us on the troln to Portland.' " The affidavit goes on to say th:it Mrs. Carter und her children, accom panied by Mr. Brownell, went to Port land and thence to Vancouver uad were sent by Mr. Brownell to Seattle, where he joined them, rented a cot tage for them and persuaded them to assume the name of Wilson. When he left, the affiant charges, he gave her $15. and told her he would send mora money biter. The record continues: "On May 24, 1015, the defendant appeared in open court and entered a plea of guilty to tbe charge set out in the affidavit Thereupon the court entered a judgment ua follows: 'It is hereby ordered and adjudged tbut said defendant Howard M. Brownell be, and he is hereby sentenced to serve three months in the county jail of Lane county, Oregon, and pay a fine of two hundred and fifty dollars ($250).' From this judgment defend ant nppeals. Modified." In passing upon this case upon ap peal to the supreme court, Mr. Jus tice Benson, who wrote the opinion, among other thongs said: The only record upon which the judgment of tho trial court is liasi-J Is the affidavit, and it does nor. ap pear therein that the right or remedy of a party was defeated or prejudiced thereby. It follows that the judgment of the lower court is modified so -that the punishment Is limited to a fine of $100, tbe defendant to be committed to the county jail of Lano county, un til tho fine is paid, tho commitment not tn exceed 50 days In duration. Miller, In a democratic political meeting at the Lane coun ty court house last night flayed the actions of Senator Charles Mc Nary, his opponent In the senator ial campaign, pointing out that the senator's vote on the republican tariff, his support of Mellon's tax plan for Newberry's seat In the sen ate after conviction of bribery, were to be condemned. Governor Walter iMerce was slat ed to talk, but was unable to be on hand, his place being taken by Will It. King, member of the democrat lo national committee and former Oregon supreme court Justice, Mr. Miller said he believed "the people of Oregon are paying more money Indirectly as a result of the republican tariff than they are for the Income tux." He promised, If elected, he would recommend a non partisan tariff commission to re-' place tariff In politics. He thinks that through the tariff the cost of farmers' supplies is raised, and through isolation the market for his produce Is lowered. He further claimed that the Mel lon plan would result In Increasing taxation for the masses, taking the burden from the wealthy, lie coi ed the plan altogether. He touched upon the republican presidential candidates' stand on this subject, having been chief counsel for the federal re clamation system under Wilson. He told that Dawes had expressed him self as opposed to further work of this nature, on the grounds that the country la at present faced with agricultural over production. "Coolldge," he said, "has tried to rectify Dowes' statement by coming out In favor of the reclamation," He said that Dawes' plan to slow up production, "when there are twenty million acres waiting fed eral aid, yet the administration says this is not to be developed for fear of over production." He ended his speech with hearty approval of Mr. Miller for the senate, and urged Lane county democrats to "stick together, don't get muddled and vote for a reactionary like Coolldtre tn hnnes of defeating LaPollette; and vote! for their party candidate for coun ty and state offices."
