Use Soldiery
Los Vegas, N. M., July 21. A clash
of authority between tue governor of
New Mexico and officials of San Miguel
county may occur, resulting in martial
lav If the prosecution in the cases of
Car, C.Mugee and Judge Richard B.
Hcna carry out their present inten
tions. s
The county officials, it is understood,
hold that Governor Hinkle had no right
to pardon Magee for contempt o court
and that the govemor'a power does nut
extend to releasing offenders against
county or supreme court judges. If they
decide to let the case come to a show
down, the prosecution will demand fcho
immediate jailing of Magee and Hitnuti
and defy the governor to release them.
Tho questions how far the gover
nor's' pardoning power extends has not
yet been brought' before the supreme
court of the state. It was Intimated in
quarters close to Governor Hinkle today
that if the San Miguel authorities per
sist in this course martial iaw mav be
declared in the county, with military
courts superseding tfisil judiciary. 1 J

na would be effected by force.
The disbarment case, against Judge
Henna continued this morning.
Magee indicated today that he : will
fight no more contempt cases, but tha$

evidence in case he is cited again by

tions and is ready to serve them at any

arranged the mass meetings out of which

Magee a counsel.
Shortly before court recessed this
afternoon, Judge Ieaby made a ruling
which distinctly shocked and amaased the
defense. Tlie prosecution had introduced
a copy of Ma gee's answer in one of the
four contempt of court cases, in which
what wan declared to be a manifest
clerical error made it appear that Magee
was admitting Instead of denying that
he was "seeking to intimidate the,
eoutt." .
The document war admitted in snite
of heated protests by Fred E. Wilson,
counsel for Judge Hanna, who pointed
out the mtpposed error to Judge Leaoy
and declared fehat no person could reason
ably be expected to believe that Magee
had pleaded guilty as would be inferred
from tho incorrect copy of the answer
introduced by the prosecution. In spite
of the sunnosed error in the document.
Judge Leahy held it as admistfable an:

President Harding's party were today
making comparisons between the gov
ernment's Alaskan railroad on whirh

the tiiiggenheini private line in the Cop
per river country, visited yesterday by

The comparisons were all in favor of
the private road wmVb. however, is ten
years older thaothe government line

hauling ore from the copper mines and

said, explained the fact that all along
the Copper river railroad there was
much freight on the sidings while not a
car of freight was seen along the entire

A movement will be begun in congress

railroad to private intirests on the
grounds that they can more efficiently
nnd economically manage the line. Mr.
Harding and cabinet members with him
will oppose the idea, believing that the
Alaskan railroad will in time lie the cen
ter of a great transportation system, in
rliiding branch roads and inland water
ways. Thia depends, however, on the devel
opment of the country, which work, in
Mr. Harding's opinion, most be patient.
