able criminal trials that has taken
place In this section In a long time

der of Captain J. Clayton Erb, hus

publican leader of Philadelphia,
i The alleged murder occurred at
1 the Erb country home, Red Gables,
In Delaware county, on October 6th,
last. Shortly before midnight on
that date a coachman from Red Ca
bles hurried to the Mountain House,
at Lennl, and notified the proprietor
of the place that Captain Erb had
been shot and' that Mrs. Erb wanted
1 help. Constable Simpson, of Rock
i dale, went to the house and on the
! strength of statements made by Mrs.
Erb and her sister, Mrs. Beisel, ne
placed the latter under arrest, charg
ed with murder. The revolver with
which Captain Erb was shot was
found In Mrs. Belsel's dressing room.
There had been a bitter quarrel, and
It was said that Mrs. Beisel had fired
the shot to protect her sister. Cap
tain Erb was found lying In the hall
way on the second floor of the house
with a bullet wound In the head.
The Delaware .county grand Jury
took up the case with the result that
a week ago it returned Indictments
against Mrs. Erb and Mrs. Beisel,
charging them jointly and separately
with alleged murder, voluntary and
Involuntary manslaughter.
Revelations following the killing
of Captain Erb showed that his re-
latlons with his wife and slBter-in-law
had been strained for some time.
Before her marriage to Captain Erb
Mrs. Erb was Mrs. W. Q. Rothermel,
a divorced woman. Their marriage
occurred about two years ago. For;
a time thereafter everything went
long smoothly, but for some months
prior to the killing of Captain Erb
there had been a succession of vloleni
family quarrels. On August 24, last,
Mrs. Erb caused the arrest. of Eugene,
Poulson, Captain Erb's colored coach-J
man, on a charge of threatening her !
life. -
At the hearing of the ca;e she
said that she had been informed that
Poulson was acting as a spy for Cap
tain Erb, who stood by the coach
man at the hearing, as against his
wife. He subsequently explained
that he did so because h eexpected to
institute proceedings against Mrs.
Erb and expected Poulson to be an
important witness in the case, in
which Mrs. Beisel, Mrs. Erb's sister,
also was to be Involved.
Captain Erb declared at the hear
ing hat ha had been duped when he1
married' Mrs. Rothermel, and that
her conduct during his absence from
home last summer had been im
proper. Several weeks later Mrs. Erb
caused the arrest of her husband on
a charge of assault and battery, and
he was held for trial. The charges
were to have been heard September
30, a week before the date of the
alleged murder, but were postponed.

The annual report of the Oregon
Electric Railway company was hand
ed into the Railroad Commission to
day, showing expense accounts and
earnings . from the first of January
to June 30th, 1908 on their lines be
tween this city and Portland.
. The gross earnings of the com
pany for the six months was $65,
340.98; operating expenses, $48,
805.77; taxes, $3,000 and net earn
ings, $13,535.21. From the net
earnings account as above, the Or
egon Electric has been doing an
enormous business, and these earn
ings were mostly derived from pass
enger trade alone owing to the fact
that during the time which this re
port covers, there was no freight ser
vice outside of express transporta
tion of the Wells-Fargo Express Co.

The Commercial club met in regu
lar session Tuesday evening with a
good attendance. Only the regular
routine of business was transacted
aside from the resignation of A. E.
Tower as secretary. His resignation
was tendered in writing and no mo
tion was accepted. Dr. W. B. Lee
was unanimously elected as his suc
cessor. Mr. Tower was a good offi
cer and his resignation was quite a
surprise to the club. , Dr. Lee Is -young
and energetic and will also
make a good, ana ratniui oincer. a
committee of three was appointed to
draft petitions and to secure names
of property owners for the improve
ment of certain streets and present
the same to the city council.
