KUTHE CASE TAKEN TO
THE FEDERAL COURT
Petition for Writ of Habeas
Corpus Filed at Portland
Yesterday
A petition for a writ of habeas cor
pus for Charles F. Kuthe, in jail in
Eugene on the charge of selling non
intoxlcatlne malt liquors contrary to
a city ordinance, was filed in the
United . States district court today,
says yesterday's Portland Journal.
Kuthe, it seems, was arrested and
fined $25. Refusing to pay the fine,
he was sent to jail for twelve days.
The petitioners assert that the Im
prisonment of Kuthe Is Illegal for the
following reasons: That the city or
dinance of Eugene Is unreasonable;

the legislature has no power to au
thorize a city to make It unlawful to
sell such beverages; that the section
of the city charter relating to malt
liquors has been suspended by the op
eration of the local option laws; that
the ordinance Is void and that the
plaintiff Is deprived of his liberty
without due process of law and
against the constitutions of Oregon
and the United States as well.

above. Sentence is wthheld pending

SURE OF ELECTION
New York, Nov. 1 6 In the opinion
of Republican leaders Secretary
Roots announcement settles tne
question of his election to succeed
Senator Piatt. So long as no an
nouncement had been made, his sup
porters were at a disadvantage and
local politicians agreed that Presi
dent Roosevelt had recognized this
weakness and Induced Mr. Root to
come out into the open. Heretofore
the opposition has stood on the prop
osition that he was not a candidate.
Timothy L. Woodruff refused to
comment on Mr. Root's statement.
Mr. Woodruff Is now the only man in
the race outside of Mr. Root. It is
announced that ex-Governor Black
Is not and has not been a candidate
and that he would not accept an elec
tion to the senatorship under any cir
cumstances.
LOST VALLEY NOTES
(Special Correspondence.)
Lost Valley, Nov. 16. Residents
of Lost Valley and vicinity voted a
five-mill road tax November 15.
Road Supervisor E. T. Templeman
called a meeting Saturday, November
14, for the purpose of voting a road
tax. A five-mill tax was voted. This
gives about $1400 to this district. At
the present writing the meeting was
still in session. Every one left with
out a motion to adjourn.
R. L. Edwards preached here Sun
day afternoon and evening.
Rhodes Wllhelm has returned
from Wlldwood, where he has been
working in a logging camp.
The Trent Debating Society voted
at the last session to Invite the Go
shen Debating Society to hold a joint
program and debate in the near fu
ture. Date and place will be men
tioned later. At the election Inst
Saturday night the following officers
were elected: President, T. H. Fen
ton; vice president, C. B. Wheeler;
secretary and treasurer, Viva Stroud;
sergeant-at-arms, Mr. Carr; editor.

Kidnaped, Mistreated and Re
turned Home, With- No
Recollection of Captors
Medford, Nov. ,16. Cleo Hurst, a
fourteen-year-old girl of this city, was
kidnaped on Friday evening, and was
returned to her home at 3 o'clock this
morning after all search for her had
proved in vain. The girl is in a pre
carious condition, having been bru
tally mistreated. The girl, who re
sides with her grandmother, left her
home Friday evening to visit a neigh
bor. She was seized and thrown into
a carriage. She remembered nothing
more until she awoke today in her
bed, where physicians were working
over her. So far the police are baf
fled for a clue as to who her assail
ants were.
BALKAN WAR CLOUD
STILL LINGERING

Vienna, Nov. 16. The possibility
of trouble between Austria-Hungary
and Servla has not been eliminated.
A semi-official statement Issued here
today states that the Austria-Hun
garian government will be compelled
to take decisive steps If the Servian
provocations do not cease. The dig
nity of the dual monarchy forbids it
longer to tolerate Servia s actions
A final decision as to the course of
the government will be reached in a
few days.
The Austro-Hungarian government
Is determined to take special military
measures without further delay.
These measures will be purely of a
defensive nature, consisting probably
in the concentration of large bodies
of troops at strategetic points in Bos
nia and Crotia. It is understood that
Servia has recalled her minister
from Vienna, but this cannot be confirmed.
RUINOUS FIRE AT .
TILLAMOOK CITY
Tillamook, Nov. 16. The most dis
astrous fire in recent years occurred
hpre early Sunday morning. Tho en
tire Olsen block and a restaurant
were burned to the ground. The fire
threatened to destroy the entire
town. Numerous buildings caught
fire from the partially destroyed op
era house two blocks away and a res
idence four blocks away ignited and
was pratially destroyed.
Following are the losses: Sapping
ton Company, groceries, $27,000;
Tillamook bakery, $6000; Dr. R. T.
Beals, $1500; Talmage & Johnson,
lawyers, $960; Masonic lodge, $500;
Reese restaurant, $1200; Tillamook
hotel, $200; C. L. Clough, druggist,
$20; Billy Stevens' .billiard hall,
$150; G. A. Edmonds, general mer
chandise, $210. By water and
smoke, P. F. Browne, shoes; Todd &
Company, clothing; Sturgeon Millin
ery Company. The fire was discov
ered at 4:30 a. m. in the rear of the
bakery. The volunteer company re
sponded. The fire is supposed to bo
Incendiary. The greater part' of the
loss Is covered by. insurance.
ROOKWOOD EXHIBIT.
There will be an exhibit of Rook
wood pottery at Eaton's Book and
Art store on Tuesday, Wednesday
and Thursday of this week. Eugene
Is the only city in Oregon, outside
