Hovey, of Eugene, and the Honeyman
Hardware Company, of Portland,
have instituted suit in the circuit
court against the Portland. Kugene
ir. Eastern Hallway Company and L.
X. Honey, Its agent and contractor,
to enjoin them from building a rail
way trestle across a lot in Sn ingfield
owned by the plaintiffs.. The lot is
near the the river on the line of the
Portland, Eugene & Eastern Compa
ny's electric railway between Eugene
and Springfield.
The plaintiffs allege as follows:
That Dorrity is owner of twenty-two-thlrtleths
of the lot, Hovey is Ihe
owner of five-thirtieths and the Hon
eyman Hardware Company Is owner
of three-thirtieths. That the railway
company uud Honey on August 22,
1D0X, went upon the land and broke
down and destroyed the foundation
of a building that had previously
stood upon the lot and tore the same
down and destroyed It to the damage
to the owners in the sum of $25.
That the defendants Immediately
thereafter began driving piling there
on and to destroy the substance of
the freehold and are building and
threaten to build a permanent ob
struction on the ground and will do
so unless restrained by the court.
A decree Is asked for an Injunction
restraining the defendants from
building the obstruction and for (25
damages.
Williams & Bean, who are the at
torneys for the plaintiffs, filed the
complaint In the suit yesterday afternoon.
