the worst mine disasters In ttie his
tory o( this part of the southwest oc
curred at HaileyvilU. fifteen miles
east of here, today, when between 25
and so miners were entombed in the
llailey-Ola mine as a result of a
fierce fire which started from a bar
rel or oil. The fire is buruinK so
fiercely that rescuers cannot enter
the mine. The miners are all for

surrounding the shaft is pitiful.

case, has replied to the criticisms
against the court. Ho said It was
not the Standard Oil Company, in
corporated under the laws of New
Jersey, the parent concern, on trial,

diana, an offspring undoubtedly, but
a much weaker organization. nut

The Wells-Fargo Express Company
will resist the payment of the tax s
levied by Assessor Keeney, of Iue
county, against the company's
rights and privileges on the South
ern Pacific Company's railway lines
in Lane county for li07. A suit has
been instituted in the circuit court,
seeking to enjoin the county from
colectlng the tax. The title of the
suit Is Wells. Fargo & Company vs.
I-ano County and Harry llo-wn. sher
iff. The complaint,, as filed this
morning by Hjo attorneys for the
company, Snow ,ti McCauutut, of Port
land, is In substance as follows:
That. In Ills assessment for the year
1907 the assessor of Lane county as
sessed the property of the plaintiff
therein as follows: Transportation
rights ami privileges over 75. !0
miles at $200, $15, ISO; personal
property, $75; total, $15,255.
That said pretended assessment as
aforesaid was transeferred to tho tax
roll of Lane county for 111(17 and a
lax levied against the plaintiff ill the
sum of $231.40, or which $2.25 was
a tax on personal property of tho
plaintiff, assessed at $75, and $2 29.
21 was a tax levied upon the alleged
transportation rights and privileges.
That It was the intention of the as
sessor ill levying the assessment of
$15,1 SO aforesaid to assess to tho
plaintiff the railway lines of tho Ore
gon & California Railroad Company
and all other railway lines in the
county opernted by the Southern Pa
cific company. That plaintiff has no
Interest whatsoever ill saitl railway
lines or in any railway lines in Lane
county. That the railway lines were
likewise assessed at such a sum ns
the assessor believed to be their val
ue. That the assessment included tho
value of the railway Hues for all
purri' s. Including their usefulness
for ti hiisportation of express matter.
Tile plaintiff avers that tho assessor
had no authority and no power to
levy a second assessment on the rail
way properties against the plaintiff,
or any one else whomsoever; that
plaintiff has no connection with the
Oregon & California itnllroad Com
pany, or with the Southern Pacific
