prosecution was made all morning

dian. He was followed by I). J. Mil

ants. Malarkey will not finish by the
supper hour ami will complete his ar
gument in the evening. . Judge T. C.
Ilecker will close the argument for
the government Itonigtfit. The In
structions to the jury have been pre
pared by Judge Wolverton, and be
fore midnight it is supposed the Jury
will retire for deliberation.
As usual, ihere is considerable
speculation nz to 1he result of the
trial. The government appears sat
isfied that thero will he a conviction
of nt least one or two of the defend
ants, if not all three. On the other
hand, 1he defense contends that It
will be nn ncqulttnl for H. A. Booth,
James Henry Booth and T. E. Single
ton. As one of. the jurors is ill and
as they have been together for sev
eral weeks, the jury may be expected
to arrive at Its verdict within a short
time after retiring from the court

Yesterday afternoon the court over
ruled the defendants' motion for non
suit.
