the above counties will not change

a majority of 9480 Instead of 8390.

The total affirmative vote on the
measure, with the exception of the
vote of Harney and Wheeler coun
ties. Is 43,253, as against a total neg
ative vote of 40,1 49. In this city the
bill has carried at the rate of 3 to
1. and In such cities as Astoria, The
Dalles, Pendleton, LaOrande, Baker
City, Roseburg. Marshfleld and Ash
land, the vote has been about two to
one In favor of the measure. In
many of the country districts of the
Willamette valley the vote has been
overwhelmingly against the Univer
sity. The country districts of this
county and of Eastern Oregon have
given more favorable returns for the
University, especially In the commu
nities where the alumni and students

Action was begun today to prevent
prohibition rrom going into effect In
Med ford, as urovided under the city
charter, says the Medford Tribune.
A temporary injunction was applied
for from Circuit Judge Hanna by At
torney Robert G. Smith, representing
J. C. Hall, to restrain the county
court from declaring prohibition in
effect in Medford, as provided unaer
the local option law. It is expected
that prohibitionists will seek to dis
miss the Injunction, which the wet
forces will seek to have made perma
nent. Attorney McAllster, of the Anti-Saloon
League, is in the city, pre
sumably to defend the league s
cause.
The charter's clause, under whlcn
the action is brought, reads as follows:
The city council shall have power
and authority within the city of Med
ford to license, tax, regulate or pro
hibit barrooms, drinking shops, bil
liard rooms, bowling alleys, dance
halls, and all places where splritous,
malt or vlnouB liquors are soia or
kept for sale, Irrespective of any gen
eral law of the state on this subject,
enacted by the legislature or by the
people at large."
The county court Is compelled by
the local option law to declare the
result of prohibition 11 days after
the election. The case will be tougnt
at every pclnt by the wet town advo
cates.
Attorney Smith said today: "This
Is not a question of sentiment, but of
law, which, I think, is altogether In
favor of the charter, which was pass
ed after the local option law. The
only suprenje court decision upon the
point Is that of the case of Renshaw
vs. the county court or Lane county,
where It was held that if the city
charter had been specific on the ques
tions involved, It would have been
binding. Medford's charter is spe
cific."

fused to commute the sentence of
death passed upon Herman Billek,
who was convicted of having mur
dered tho entire Vssral family in Chi
cago. Billek ns convicted after a hard-fought-legnl
battle, which lasted two
weeks. Tho poisoning of the Vzral
family was a mystery for months be
fore the crime was fastened upon Bil
lek. The murderer will be hanged
Friday.
