Coe D. Barnard was convicted In
the United States court in Portland
August 11. 1906. on a charge of per
jury in having made a false affidavit
as witness in the final homestead
proof of Charles A- Watann. The jury
reported a recommendation of clem
ency, and Barnard was sentenced to
two years at McNeil's Island and
i fined $2000. The maximum penalty
; for the crime Is five years and a fine
of 12000. Judge A. S. Bennett
i counsel for Barnard, appealed the
1 case to the circuit court of appeals.
' Barnard will now have to serve the
' sentence of the court. W. C. Bristol
who was United States attorney at
the time, secured Barnard s convle-
tlon, and argued the case on Appeal
for the government.
Watson, In whose bohalt Barnard
committed perjury, was also Indicted
I for the same crime. He pleaded
guilty August 8. 1906, and because
j of his physical CQntf'tlon sentence was
I suspended.
