This movement to enforce the for
feiture of the Southern Pacific land
grant is taking on a phase that was
not expected by many of those who
helped to Inaugurate the movement
against the railroad company, fa
der the wording of the Fulton reso
lution, pending In congress, the ac
tion against the road grants may In
volve large and small purchasers of
the lands, as well aa the railroad.
,and many protests are going to Wash.
Ington against the adoption of Sen
ator Fulton s Joint resolution bv tha
I bouse of representatives. The rail
road aol4s 2,000,000 urea In viola
tion of the terms of the grants, and
purchasers who bought la violation
of the terms of the grants more
than the ISO-acre limit for each pur
chaser,' at a price exceeding 12.50
per acre, and not being actual set
tlershold some 700,000 more acres.
The resolution Is so broad as to
cover all violations of the terms of
the grants, both by the railroad and
by timber speculators, and by small
buyers. It authorizes and directs the
attorney-general to bring suits In
equity "to enforce any and" all rights
and remedies of the United States."
"Old Borax" Vtley may find him
self boomed for president by the
whlskeyltes. In a recent speech he
said: "While alcohol is bad for the
human system, whiskey Is exceeding
ly good for the alimentary secretions,
the constituent matters that go to
make up the product overcoming the
bad effect of the alcohol in It. A
man. should be. allowed to take a
drink when so disposed." In these
prohibition times that's surely say
ing some.
Maybe the official announcement
that there was more than a billion
dollars in gold coin the largest
amount ever gathered in one place
and under one control in our treas
ury had something to do with the ef
fusive friendliness Japan has recently
been displaying toward Uncle Sam.
It took President Diaz, of Mexi
co, twenty-seven years of dictatorship
to arrive at the conclusion that It
would be undemocratic for him to
continue the Job after his present
term, and the announcement of the
conclusion may be a grandBtand play
at that.
It did not require a senatorial Sol-1
omon to convince anybody that "the
demand for money has for years been
growing faster that the supply," nor
that It will continue to grow faster,
regardless of laws. Did any man
ever have all the money he wanted?
If half that's printed concerning
politicians making use of the affairs
of the closed state banks in New
York to boost themselves be true, 1
somebody Is liable to get badly stung
sooner or late. You can't safely mon
key with money.
What will the college professors be
"knocking" pext? Here's a profes
sor of American history saying that
twenty-six of our presidents have not
been up to the average of some rul- i
ers of England and France.
Maybe It was luck that enabled
Former Governor Bradley to land
that Kentucky Senatorship, though
we are confident that Former Gov
ernor Beckham would give It anoth
er name.
Mr. Bryan probably doesn't feci
a bit thankful toward those who are
saying that they favor his election
because the Republican senate would
stand In the way of his doing any
thing. A Maine man has a churn which
has been in his family for 170 years,
and we strongly suspect that some of
the butter It turned out when It was
new Is still being sold in this town.
If Wu Ting Fang, the new Chinese
minister, Is right In declaring that
the open door policy is In effect In
Manchuria, an awful lot of lying has
been done by others on the subject.
A noiseless gun has followed
smokeless powder and, though there
Is no definite Indication of his com
ing, we can at least hope for the hot
airless orator.
Good for mcrrlimly.
Mr. Norman Coulter, a prominent
architect In the Deibert Building.

TUK THIS KVEXIXU
Probably no entertainment event
ever given in Kugene by local talent
has caused as much favorable com
ment as the Elks minstrel ahow, and
those who did not have the pleasure
of seeing the boys on Thursday night
will have the opportunity toulght.
Many of those who attended the show
at its first presentation have bought
tickets for tonight again as new Jokes
will be Introduced and several new
songs will be put on. One of the new
features will be the Henry Glbbs
quartette, which will appear In the
big plantation scene. Introducing sev
eral southern melodies. If you have
not seen the show, by all means go
tonight, and if you did see It, go
again and hear the new Jokes and
songs to be presented.
HIIA'LIXKM HAVE
REACHED CAPACITY.
Washington, March 5. Argu
ments of the Pacific Coast LitmhT
case were resumed before th? Inter
state commerce commission this mor
ning. J. D. Kerr, represoiuin'K the
Hill roads, frankly stat"d that the
Northern Pacific and t'.rcat North
ern have reached their capacity for
handling traffic. He said as the de
velopments of tho northwest contin
ued, traffic would Rrow. '
Therefore existing roads must in
crease their capacity or new roads
must be built, but h? declared no
new roads would be built to haul
lumber unless they had a guarantee
of a rate that would be remunerative.
If the old non-compensatory lumber
rate ' is continued in effft, money
cannot be procured and railroad
building will stop, he said. Kerr de
nied that the lumber men would be
injured by an increase In the rate.
They can absorb the Increase and
still make a handsome profit, be
declared. The Booth-Kelly Company,
In Oregon, which is not opernted un
der favorable conditions could on the
basis of an advanced rate still earn
31 per cent annually on Its Invest
ment. Some companies could make
larger profits, others not so much.
Relative to the arguments tbat lum
ber cannot move Into competitive
territory under an advanced rate,
Kerr showed that the St. Paul and
Tacoma Lumber Co.mpany of Ta
coma paid 5 cents Into this district
for years and made good profits. This
is higher than the proposed new rate.
