United States District Attorney Hall,
accused of being involved In the land

"1 never dropped the prosecution
ot a case in my life, as those who are
under indictment in the bribery and
graft cases will learn when I return,"
said Heney, when told of the reportB
that Tlrey L. Fdrd,, general counsel
;of the United Railroads, would not be
It-ought to trial, and that other in
dictments and the prosecution of Cal
houn would be uropped.
: Heney said that such reports re
garding the Oregon land fraud cases
I were also without foundation, and
1 that the Indicted persons would be
j brought to trial.
Speaking of the open letter of Sen
l ator Fulton, calling upon Heney to
j prove the charges against him, the
: prosecutor said:
i "Many ot the facts against Fulton
; will come out in the trial of Hall and
i the senator may- learn more than he
! may wish."
I He said he did not believe the
, charges of perjury against S. A. D.
Puter would be pressed, and denied
the report that he was severely crit
. icised by Roosevelt. On the contra
, ry, he said, the president had received
him warmly and "twice had invited
I him to luncheon.

CALIFORNIA APPELLATE COURT HAS
RENDERED DECISION RELEASING SCHMITZ
AND CLEARING ABE RUEF OF CHARGES
mm
decision will probably affect the case
jf Abo Kuef on the same charge.
According to the appellate judges
, the compelling of the French rostau-
rants to pay big "fees" to Ituuf was
I not a crime, even though Kuef dlvld
! ed tho "fees" with the mayor.
After discussing the point the court
reverses the judgment malnst
Schmilz on the ground that no act
, constituting a crime had been pr.iveil
against him. Kuef, who pleaded guil
ty to extorting money from the
; French restaurants, Is therefore
' equally guiltless.
; The decision wipes out the French
; restaurant cases and the pending
charges of extortion against Sclimit.
land Kuef must be dismissed. Hoth
are entitled to a release on bull nit
' til such a time as tho jury finds them
guilty of accepting bribes from cor
i ponitions. Owing to the number of
cases against them, hall, fixed at
! $10,000 In each case, will amount to
j an enormous figure.
I will probably be appealed there again,
nlthough the Jury was out only ten
minutes.
' It was admitted that Myer made
, his contract under a void lease, nnd
i for that reasoif the buyers tried to
; evade payment. The point Involved
was whether a sub-lessee could re
cover for money expended in making
a crop, when his title to the use of
the laud was in question. It Is a case
that has attracted a great deal of at
tention among hop growers and buyers.
