Jury After Being Out Until Late Last
Evening Finds Emit Etter Guilty.
Mayhew & Ware Case Tried To
day and Beginning Made on

i Frank Ware, charged with violating
the local option law, was ended today

Shortrldge testified that he enter
ed Mayhew & Ware's place on No-1
vember 12 and called for a pint of
ginger ale. He received a pint of
whiskey, for which he paid 25 cents.
The hottle of liquor was introduced
as evidence
Southworth testified that he had
been in the defendants' place and
called for ginger ale and got liquor
Elliott and the Griffin brothers tes
tified that they had been in the place
and called for drinks. The Grifflm;
said they got something to drink but
did not know what it was.
Charles Mayhew and Frank Ware,
the defendants, testified that thev
never sold anything to either South
worth or Shortrldge.
The jury In this case was as tol

j Amos Wilkins, J. A. Clearwater,
James Calvert, R. W. Newland, Geo.

At four o'clock this afternoon the
jury had not agreed upon a verdict.

The jury in the Etter case returned
a verdict of guilty last night about
nine o'clock, after being out eight or
nine hours.

The trial of Herman Breyer, on thi
same charge, began immediately af
ter the Mayhew and Ware jury went
out. Four jurors were accepted, but
as the venire was exhausted it be
came necessary to take a recess un
til the other jury returned.

L. A. Freeze, who waa committed
to the Insane asylum at Salem about
11 years ago, died In that institution
Monday night, and his remains will
arrive In Eugene tonight tor burial
In the Mulkey cemetery. The cortege
will lenve Gordon's undertaking
chapel tomorrow morning at 9: 3D
o'clock. Tlte deceased was a brother
of Mrs. Floyd Vuughau nnd was 5S
years of age. He was single, having
never been married.
