Sai.km, Feb 21. In the supreme
court, yesterday, the ease of the State
of Oregon, respondent, vs Claude
llranton, appellant, an appeal from the
circuit court of Lane couuly, Hon J W
Hamilton, judge, was argued and sub.
milted. A brief statement of the case
is as follows:
The appellant, Claude Briintou, was
severally Indicted by the grand jury ol
Lime county, Oregon, on the 2tilh ol
October, 1S93, charged with the crime
of murder in the first degree, by kill
ing John A Linn on the 15th ol June,
18118, in Lane county. Ou the day that
the indictment wat returued into court
the defendant was arraigned, entered
a plea of uot guilty Ihe t'ullowiug day,
and thereafter was dulv convicted of
murder In the Hint, degree, as charged
lu ihe iudictuient, aud was seuieuced
according to law.
On October !!!, 1S9S, the same grand
jury returned into court an indictment
against Courtlaud Green, charging
liim illi Ihe crime of murdering John
A Linn. 'I'tiere was no reference by
innuendo, or otherwise, coutalued lu
the last indictment to the complicity
of Bianton, or any one else lu the com-
mission of Greeu's crime. Each sep
arate indictment contained the stale-
nient of a complete crime charged
ai;aini-t each of the defiudauts. The
theory of the prosecution was that
lii union aud Green were both actually
picseut aiding and abetting each other
in Ihe commission of ihe ciimlual act
of killing Linn. That the criminal act
that took the life of tlio deceased was
111 luw the act of each individually, as
well as of both.
The contention of the state wan that
murder, unlike riot is a teveral crime.
That in a crime like murder the crimi
nal can be Indicted alone, tried alone,
and the full penalty be indicted upon
him the same as though ho committed
the crime unaided. That a criminal
act! in is uuliko a cival notion. That lu
a criminal cause the defendant cannot
be heard to plead or say that another
has paid the debt I owe tlio law.
After the trial of the appellant had
been set, but before trial had, Court-
land Green plead guilty to the Indict'
nient against him. The couusol fur
appellant claimed thntGreen'a plea of
guilty was an acquittal of Branton
and made various moves in the case
ou that theory, and the ruling of the
court thereon Is assigned as error.
They Bought to withdraw Branton's
plea of not guilty, lu order to demur on
the grounds that Green had plead gull
ty, and also moved the court during
the trial to instruct thejury to return
a verdict of acquilal as to Branton, on
the grounds that Green had pleaded
guilty to killing John A Linn, and
claiming that was acquital of Bran
ton. It was also claimed that the
court erred in overruling defendant's
motions for a continuance, and that
the court erred In overruling appel
lant's motion for a new trial.

on one side, aud the trees may live but
their strength will begieatly impaired.

roses are killed, and nearly all frozen
down to the snow Hue. Small fruits
have fared 111 a similar manlier. Some
strawberry beds that were protected by
the snow ure in a good condition.

"In the red hills, south of the city.
the crops of petite prunes, peaches and
some varletlea of plums are almost
completely ruined, while the Italian
prunes seem to be safe.
"It cannot yet bo Btated to what
extent the grain has beeu killed. The
rule appears lu be that all wheat that
was proleuted by a covering of snow
has come through all right, whllu all
that was not so protected has beeu to
a greater or lesser degree killed, and
must be reeown."
