The commissioners couti st case was

and the contestee, H 1) Edwards and
his attorneys, AC Woodcock, J M
Williams and C A Hardy. A tew
spectators were present at today's ses
sion, whic'i resulted mainly in the
hearing of motions.
As the case now stands a motion was
first argued by U D Edwaids through
his attorneys to nun-suit the case. It
was overruled by Judge Hamilton.
Defendant was then granted per
mission to file u (It nun nr, and after
hearing argumeut of counsel, same
was sustained.
Plaintiff uiovid court for time to
file amended complaint, which being
granted adjournment was had until 7
o'clock Ibis evening.
The general cause of contest Is famil
to nil. In the June election the count
of ballots showed Edwards to have a
majority of one vote over Buughmuu
for the uillco of county commissioner.
Pl'iintiff Buugbmuii alleges that error
were made to t lie extent that a recount
of ballots would show that ho Bsugh-

at the proper time, took his oatli of of
fice, and awaits tho development of
the present suit.

I'he mystery that has apparently
surrounded the ru'urii of Claude Bian-
tou to Lane county and his motive for
so doing may in a way be explained
by further conversations held between
him and the ofllcers.
Deputy Sherilf Day informed a
GUAM) reporter today that they were
ill possession of evidence which en
abled them to say authoritatively that
Claude lirauton told the truth when
he said tliat be had been in Top ka,
Kansas.
This makes it patent tliat limutou
felt secure when ho stepped fiom the
traiu in this city aud walked with a
firm step the streets of Eugene. Be
fore leavh g Courtnoy Green lie had
made such threats to enforce secrecy
that apparently no thought had
crossed his miud that Green would
reveal tho crime to the ofllcers.
It was from young Herbert Finn
that Uruutoii first learned of Green's
arrest, and the fact that n reward of
$250 was hanging over Ills own head.
Then it was tliat he began to get ap
prehensive aud wanted to get out of
town. When he left Finn on Eighth
street near the IS:ipt 1st church it was
to rapidly Increase his gait in the effort
to get out of town a id Deputy Slier if!
Day nn nearly a block in his attempt
to gain on lirauton. When Finn told
Branton tf walk with him to tho court
house and give himself up to the
olllcers so that ho, Finn, might secure
the reward, Branton replied, "Wait
until I get out of town and you can
have the roward," implying that it he
could ence get away and in a position
to protect himself it would boa hard
mutter to place him In custody,
lirauton and Green are confined in
cells at opposite sides of the jail, bo
that conversation between them will
be lather liml ed aud difficult to lu
dulgo iu.
At present tho timo of preliminary
examination rests entirely with Ho
defense. As District Attorney Brow i.
is very desirous .f being present, hav
ing came down this morning solely for
that purpose, it will either be held to
morrow or postponed until Monday
August 1. Mr lirown leaves in a day
or two to attend circuit court in Lin
coln couuty and will not return until
then.

BACK KP.OM SOUTH AFRICA
G W Hlnyton. Returns From n Visit to
Juliniinesliurg'.
G W Slayton, of Prlnevllle, who
spent (he last two years at Johannes
burg, South Africa, has leturned to
Oregon, quite well satisfied that Ameri
ca Is a good country In which to live.
Air Slayton was attracted to Africa by
the allurements of the gold fields, and
says for big investments and gigantic
schemes that country Is all right,
though when he left there last May
business was quite dull, the bottom
having dropped out of the boom, and
transactions had settled down to a nr r
mal state.
Mr Slayton states that American
products, such as Hour, lumber and
Borne coarse grades of goods, are prom!
neut iu Johannesburg markets, and
considerable American machinery Is
sold In the African mining districts.
There Is, he says, a general belief in
Africa that Pnciflo coast fruits, arc in
ferior, and ihus we are deprived of a
good trade In that Hue that could be
secured If shippers would exoiclse more
care in packing. If our fiults wereput
ou file market in a shape to suit the
tiade, il w ould be but a short time un
til It would be in demand.
It will be remembered tliat Mr Slny
lon Blurted on his trip from Eugene.
He is known by many of our citizens.

COST OK CONTKST.
What will Lane Couuty Pay in the
Coininissioueislilp Suit.
Some speculation has been Indulged
in as to what the commlssionersblp
contest case will cost Lane county.
There are 44 precincts iu Lane coun
ty. From each of these voting places,
a clerk or a judge, perhaps both, will
havo to appear to testify whether the
the ballots have been securely kept.
As the distances of the vartoUB pre
cincts from Eugene averages at least 20
miles, and several days must of neces-
ity be consumed In taking testimony,
it will bo seen that the witness fees
and mileage count up rapidly.
Wo learu that the contestant Is wil
ling to stipulate that the ballots be
counted without calling the witnesses.
Couflrmed by the P I.
From tho Seattle P I: The Post-In
telligencer presents this morning the
last picture of "Soapy" Smith, tho
uncrowned king of Skagway," who
was shot and killed by Frank Reld,
July 8, on tho wharf at Skagway,
while eudeuvoriug to break up a citi
zens' indignation meeting.
It Is a remarkable thing, yet Just
what one would expect of "Soapy,"
that he died a poor man, notwith-
s tandiug the enormous sums of money
ho made. At the height of the Sksg
wuy boom there Is little doubt that he
made from $200 to $250 a day. When
tho committee of "101" wub running
tlie bunco men out of Skagway last
March nnd poBlcd notices warning
grafters of somethlug to happen,
Soapy" walked through the town
pulling down the signs and saying. "I
am the uncrowned king of Skagway,
and they can't drive me away."
Smith's people, excepting his wife,
live at Bolton, Texas. Sporting men
admit tliat Frund Reld, city surveyor
of Skagway' did a good Job when he
killed Smith, yet they also say that It
remains a fact Hint Smith was the
most popular man In AlaBka.
Reld recently lived at Whatcom,
Wash. Ho came originally from Sweet
Homo, Oregon, where his family la
well known. In 1870 Reld had trouble
over domestic affairs with James
Simon, It was claimed that Simon
threatened to kill Reld. Th two men
met ono day. Trouble followed and
Reld tbot Simon dead. After a long
triul he was acquitted oi the ground
of self-defense.
