B1U INJUNCTION Sl'lT.
The City Treasurer Unstrained
From Paying the Bridge
Vfnr routs.
Albany Democrat: Deputy Sheriff
Quiueey Propst last evening served
upon City Treasurer E A Parker a
temporal)' Injunction signed by County
Judge J N Duncan, restraining him
from paying oertaiu warrants of the
aggregate amount of $9,073.0S held by
the Portland Bridge Company, and na
well restraining said bridge company
from transferring said warrants or dis
posing of them until ordered by the
circuit court. The complaint upon
which the injunction is granted is
made by D B Monteith, who states in
the complaint that he is assessed for
about $10,000 and pays $S0 city taxes.
The allegations In tho complaint are
that on July 2S, IS91, tho city council
wrongfully and unlawfully authorized
J L Cowan, mayor, and N J Henton ,
recorder, to nmko a contract for tho
construction of a steel cantilever bridge
across tho Wlllamotto; that on Sept
19, a second and supplemental pre
tended contract was uiado providing
for the payment of $5000 more on no-
count of certain changes, and on May
9, 1892 a third pretended contract was
made providing lor the payment of
18.30 on account of tho Benton
county approaches, a total of $90,884.
30; that on Murch 9, 1892, a warrant
was issued for $3189.08, on April 27,
1892, one was issued for $5000, after
wards on Sept 20, 1894, divided into
five 1,000 warrauts, aud on July 2,
1892, ouo for $3S4.30, thut said warrants
unlawfully wore made to bar 8 per
cent iuterest. The complainant
alleges that the city had no right to
nmko any such contracts; that It was
indebted for $10,000 aud that no part
was issued to repel invasion or suppress
Insurrection. That tho city was ex
pressly prohibited by stain to from
creating a debt of over $5,000 except
the bondod indebtedness of $75,000 and
therefore the warrants were issued un
lawfully. The complaint asks for a
temporary injunction aud a hearing
for a perpetual Injunction restraining
the collection of the warrants lot
forth.
