ct al vs. the City of Eugene, which is the suit brought
to restrain the mayor and council from proceeding with the
building of an electric power plant on tho McKcnsie river, Judgt-
M L Pipes and City Attorney J M Pipes appearing for the city,
and Thompson & Hardy and Woodcock A Potter for tbe plain­
tiff.
In his decision, which was verbal. Judge Hurris finds for the
city on every legal point involved tn the controversy, and dis­
misses the application fnr n permanent injunction. Il is not
Known al this lime whether the plaintiffs will take an appeal to
the supreme court.
