New York, Nov. 25.—Andrew Car­
negie. who has earned for himself the
title of the world's most noted phil­
anthropist-capitalist, was seventy-one
years old today. Thanks to his sim­
ple life and regular habits. Mr. Car­
negie is In the enjoyment of excellent
health. Despite the whiteness of his
hair and beard he might easily be ta­
ken for a man of sixty years or even
younger. His devotion to golf and
other forms of outdoor recreation has
kept him fn the best of physical con­
dition.
It is estimated that Mr. Carnegie's
public benefactions in 1908 amount
to about $15,000,000. Since he made
up his mind that it is not good to die
rich he has given away a total of
about $150,000,000 of his colossal
fortune and he declares he is still
ready to give. Notwithstanding the
generous hand with which he has
scattered his millions for the benefit
of the people on both sides of the .At­
lantic, there appears to be no chance
of Mr. Carnegie dying poor. His in­
come is estimated to lie considerably
in excess of his benefactions, though
the latter average more than $1,000,-
000 a month tne year round.

state scored a big victory in the Lam-
phere trial when Judge Richter, after
exhaustive arguments on both sides,
announced that he would instruct the
jury that i[ the evidence shows that
Lamphere set fire to the Gunness
house, even if the fire did not cause
the death of any persons therein, the
jury must find him guilty of arson.
The instructions will also contain a
paragraph that if the jury finds that
any one of the four persons in the
house lost his or her life as a result
of tbe fire, and that Lamphere set
that fire, then It must find Lam­
phere guilty of murder of manslaugh­
ter.

politicians are of the opinion that
Thomas R. Marshall, Democratic
governor-elect of Indiana, will have
some advantage as a Democratic pres­
idential possibility in 1912 over Gov­
ernor Johnson, of Minnesota, three
times elected as a Democrat, and Jud­
son Harmon, the Democratic gover­
nor-elect of Ohio. Their judgment is
based chiefly upon the fact that the
terras of both Johnson and Harmon
will expire two years hence and they
will be compelled to be re-elected to
retain their prestige.

house of representatives for the sixty-
first congress has been completed and

and 172 Democrats, a total of 391. as
against a total of 389 in the house
during the last session, of whom 223
were Republicans and 166 Democrats
The result is a net loss of four from
the Republican side and a net gain of
six on the Democratic side, the dis
crepanev being due to present vacan­
cies. All told, the Republicans gain­
ed twelve d'strlcts and the Democrats
seventeen.
