STATE WINS IN THE
OREGON CITY LOCKS CASE
The state.'s interest iu the locks at
Oregon City to'Hie amount of »200,-
000 was confirmed today when the
supreme court denied the petition for
rehearing the case of the State vs. the
Portland General Electric Company.
This amount by today's decision is
ascertained to be an investment from
the common school fund by virtue of
an act of the legislature of 1870,
which granted a like sum to the roig-
inal company for the construction ot
the locks.
Furthermore, an accounting is now
due from the corporation by which
the state will receive ten per cent of
the net revenue from the locks since
1x97. The sum will revert to the
school fund.
By the terms of the
original grant It) per cent of the pro­
ceeds should have been paid to the
state annually, but all that share
which should have been paid before
1X97 can never be recovered by the
state because of the statue of limita­
tions. The case was decided in May.
The way is now clear for the joint
purchase of the locks by the federal
government and the state for which
purpose the legislature has already
appropriated »300,000.
The locks
will then be free to navigators.
