A fierce lgal battle with big

at stake, is being waged in the
land fraud cases at Tortlaud.
Some of Oregon's most conipic
ious public rueu have been ub
poenaed as witnesses. Among
those who have alrea ly been on
the witness stand are Hon. Wil
liam Galloway, judge of the cir
cuit court, department No. 2, of
the Third Judicial District; Hon.
C. B. Moores, Ex-Register of the
United States land office at Ore.
gon; non. Binger Herman, re
presentative in congress of the
First Congressional District of
Oreeon. In the course of the;
examination of
letters written to him
by Senator Mitchell presumably
relating to land matters were
handed Mr. Herman by Gover
ment Attorney Heney for identi
fycation. Upon introduction 'of
the third letter, objection was
interposed by Judge Pipes, attor
ney for defendants and the letter
was withdrawn. "Why did you
submit tfcem?" asked Mr. Pipes
"Because I expected to identi
fy them by Mr.Herman"answer
ed the attorney as his face flush
ed and his voice shook. "Be
cause 1 expected to identify

them by Senator Mitchell

have him here. I am now try
ing to get him and I will con.
nect with this paper later. I ex
pected to prove the letter by Mr.
Herman, and failing . withdrew
it until Inter."
This would indicate .that Sena
tor Mitchell also, will be one of
the witnesses.
The lawyers in the case are
Judge Pipes, Thomas O'Day and
Mr. Pater, brother of one of the
defendents, pitted against John
H. Hall United States district
attorney and Special Prosecutor
Francis Heney of San Francisco.
Judge Pipes has already convin
ced the court that he has the
courage to object to most any.
thing the prosecution has the
temerity to offer as evidence.
As a technical lawyer, it is
doubtful if Mr. Pipes' peer is . to
T found in the west and it will
not be at all surprising if he
finds grounds for throwing the
case out of court before it ever
reaches the jury. Should it go
to the jury, the defendants still
lave two chances-acquittal or
a hung jury.
While attempting to remove
his trousers preparatory to re
tiring Tuesday night, Til Ford
of Salem fell and broke his log.

The ceremony was performed at
9 o'clock and after a wedding
breakfast the wedded couple de
parted tor their future home near
Florence. Lape county. The bride
is a highly respected Polk county
lady of pleasing manner. Of a
family of nine children, she is the
first to leave the parental home.
The groom owns a stock farm near
the beach in Lane county and
there Mr. and Mrs. McRae will
make their home.
