It was to get an outlet durinc the winter the petition was presented. Deferr- J ing action in the matter is prac tically a nullification of the or der which stands of no effect until work is begun. If work on opening the road is not to be gin until next year or year after, or 1009, the" order opening it should have been reserved until that time.
