Hotel. Albany. He is making

At the regular meeting of the
state land boad Wednesday, in
pursuance of a decision returned by
the attorney general recently, hold
ing the act pass! by the last legis
lature invalid and not binding upon
tha board as to the price at which
chool land should be sold because
achool land was omitted from the
title, the board made sn order fixing
the price of school land at fi.oO
per acre as contemplated by the
Legislature and raising the price of
all school lands located within pro
posed temporary withdrawals for
reservation purposes, to $5 per acre,
as contemplated by law. This deci
sion and order emanated from an
application having been ma Je by
one who wanted to purchase a tract
of school land in a section situated
in the reserve, and maintaining
that, under the new law the board
was compelled to sell the land ot
$2.50 per acre. The matter was
submitted to the attorney general
with the result that he rendered a
decision holding the act invalid as
to school laud and that the matter
rested solely with the Board to fix
any price upon it not less man i.-o
per acre.
The Board also decided not to
accept final payments on cer
tificates ot Bale of any state land
unless the certificate accompanied
the remittance. This is done to
prevent the purchaser from sending
in final payments and not securing
a deed thereby escaping taxation.
