Mr. Jones left Thursday morning
for the coast but eipeeta to be home
to be present at the next meeting of
the council.
Later on a representative of the
Enterprise called upon Councilman Bo
hannou. chairman of the ordinance
commute, under whose dictation the
ordinance In question, referred to by
Mayor Jones, was drawn, and that

he had read section 59 of chapter
of the city charter, said:
"Yes. and I was Informed this
murnltiir that the mayor had made
the statement publicly that the ordi
nance recently passed by the coun
cil was not In accordance with the
provlsiona of the city charter and wa
therefore of no legal value. In n
much as It provides for the IshuItir
of bonds against, the entire city In
stead of abutting property, as et
down In the section referred to. The
ordinance was drawn under the pro
vision of section 43 of chapter 7
which reads as follows:
SECTION 43. If the council de
clares by ordinance that a proposed
Improvement or repair shall be at the
cost. In whole or in part, of tne ad
jacent property, the proposed Improve
ment or repair shall be made accord
ingly: but If It declares that the cost
thereof. In whole or In part. Bhall be
Dald out of the general fund, such
repairs may be made as the ordinance
may provide, and Ue paid for accordingly.'
"You can readily see that section
43 leaves it to the option of tne coun
cil whether or not the improvement
repairs proposed shall bo taxed
up to tne aujaceni property or ui
city as a whole. In this Instance it
was decided, after due deliberation,
hat the best method to adopt for the
city would be by a bond Issue of the
entire city, they being more saleable
the market than Improvement
bonds Issued against the adjacent
pVperty.

will be observed that it invests In the
council power to 'law down all nec
essary sewers and drains and cause
the same to be assessed on the prop
erty directly benefitted thereby, If it
sees fit to do so. But In no manner
rWa it state that the council snail
have fhe power to do the work and
nay for the same out of the general
fund as the ordinance may provide.
"In mv judgement the grounds up
on which the mayor bases his opinion
of the non-legality of the ordinance
are very flimsy. The ordinance com
mittee, of which I am chairman, in
connection with the city, attorney ful
ly analyzed the provisions of the city
charter before drawing up and sub
mitting the ordinance and I fel con
fident that It will stand the test of
the courts if Us legality Is ever ques
tioned, "The trouble with the sewer ques
tion Is that outside of the members
of the city council and city officials
who have been considering the matte
for the past six months, the people
are not conversant with the facts in
the premises. If they had been there
would have been no referendum peti
tion, which .was, in my opinion, the
loutgrowth of misrepresentations of
the facts by interested parties. It Is
well known the more often a story
Is told the bigger It gets and this
can be practically applied to the mis
representations relative to the sewer
proposition.
"It Is now generally understood
that the system proposed by the cdun
cil takes in about forty blocks, prac
tically the entire city with the ex
ception of that portion known as old
town or North Independence, and a.
small portion of West Independence.
As the ordinance Includes the sew
ering of the entire city whenever
the accasion demands It the people
In old town can by petition have the
sewer extended to that district. There
should be little' or no opposition to
the sewer proposition from any quar-
i ter.'"
