under the auspices of the Elks. Odd
Fellows and Wooodmen lodges. George
M. Brown, who delivered the eulogy
upon behalf of the Elks, characterized
Mr. Benson as the most popular and
distinguished man In Douglas County.
"More than 30 years ago, as a teacn
r In the Umpaua Academy, at Wil
bur," said the speaker, "he gave to
: prominent men all over this section as
lofty aspirations and as noble Ideals as
any American boy or girl ever receiv
ed. In the school room he was dif
ferent from the ordinary teacher, he
. was modest and timid, but yet there
was an Intellect as bright as a dia
mond and in his breast a heart as pure
' as gold. He was a man among men."
At the conclusion of the exercises at
the Elks' Temple the body was taken
to the Odd Fellows' cemetery under
escort of the Odd Fellows, Elks,
Woodmen and Company D. Oregon
' National Guard, wheer the final rites
of the Odd Fellows' lodge took place.
Judge Thomas F. Ryan, of Oregon
City, was master of ceremonies.
The floral offerings were many and
beautiful and showed in a measure the
universal esteem in which Mr. Bemson
was held throughout the state.
Most of those who attended the
funeral from a distance left for their
homes tonight.

WILL GATHER AT CHAMP0EG
Pioneers to Celebrate Establishment of
Provkdonal Government.
On May 2 the sixty-eighth anniver
nrv of the establishment of the pro
visional government of Oregon will be
celebrated at Champoeg. Judge F. Jt.
D'Arcv will be president of the day,
Bnd Hon. Charles B. Moores, of Salem,
vlll deliver the principal address.
Slxey-elght years ago the pioneers of
the Oregon country gathered at Cham-
noea. tho little hamlet In the norm
western corner of what is now Marlon
County, and decided the momentous
Issue whether the Oregon country was
to be British or American.
The vote was close, 60 favoring the
Tirltlnh and 52 the American. F. X.
Matthleu. a French Canadian, and
Peter Lucler cast the deciding ballots.
Matthleu is the sole survivor of that
historic gathering, and he will be pres
ent at the celebration.
The action taken by the gathering at
Champoeg In 1843 established the first
white man's government west or me
Rockies. It was a provisional govern
mcnt, and later resulted in the terri
tory of Oregon being formed.
The origin of this convention was a
teculiar one. relates the Salem States
man. The pioneers were bothered
with wolves that destroyed their flocks
of cattle, and meetings were called to
devise ways and means of protection
against this form of loss, for in those
days, cattle were a great source of
wealth to the scattered pioneers.
Three such meetings were held and
jvere commonly called "wolf meet
ings." The third of these meetings became
the constitutional convention, for the
pioneers found that some kind of gov
ernment was a necessity, and It was
decided to take action.
Each year the pioneers gather at
Chnmpoeg to celebrate the occasion In
a grove where speeches are heard.
An attempt was made to secure a me
morial building for these occasions and
a movement to that end was launched.
It was successsful In securing the
passage of an appropriation through
the house of representatives during
the lnfct session of the legislature, but
the bill was killed In the senate.
BIG WELL IS YET UNCHECKED
Walla Walla Valley Folk Worry Over
Draining of Reservoir.
WALLA WALLA, Wash., April 18.
Efforts to check the now famous Kelly
artesian well have all proven In vain
and owners of other wells in the valley
are becoming alarmed over the possi
blllty of this one huge well draining
the reservoir that supplies the artesian
belt. Casing after casing has neen
sunk In vain endeavors to control the
flow of the well, but the water has al
ways washed up around the casing,
and the only result is a bigger hole
and more water. It Is estimated the
flow now is between 400 and 500 gal
lons a minute.
Experts from the oil districts may
be summoned to cap the well or the
clan used in oil districts of checking
the flow by the weight of the water
may be used. In this case a tank 20
or 30 feet high would be built and as
the water would not flow above the
top. the flow would be stopped and
controlled as effectually as if it was
cased and capped.
The bore of the well is now nearly
12 inches, and washing larger every
day.
PRICE OF TIMBER LIMITED
Lafferty Offers Hill to Prevent Gov
eminent' liaising It.
WASHINGTON. D. C. April 18.
Congressman Lefferty introduced
bill to require the sale of unreserved
timber land to Individuals at $2.50
nn acre. In tracts not exceeding 160
acres to any one purchaser.
Until two years ago the timber and
stone act had been construed to re
mit the sale of timber lands. The
Interior Department in November,
1909, practically repealed this act by
providing timber lands be sold only
at appraised value. The object of the
Lafferty bill Is to virtually restore the
timber and stone act. He claims the
act has never been repealed by Con
Kress, and there Is no evidence of
Congress' action as to the Interior De
partment in abrogating the same by
the Issuance of regulations.
Lafferty Introduced a bill appropri
ating $150,000 for a public building at
Astoria.
Also a bill authorizing a homestead
