Indy council to rework pot law

INDEPENDENCE — The
public comment section of
the Independence City Coun-
cil meeting on Aug. 8 began
with a comment from Alex
Andrade, owner of Blackbird
Indica, asking the council to
reconsider the licensing
process for marijuana busi-
nesses in Independence.
The ordinance currently
requires those applying for a
license to operate a marijua-
na business within city lim-
its to provide the city man-
ager with various pieces of
information about their
business, as well as the busi-
ness owners and employees.
This includes “a complete
copy of both a nationwide
criminal history report ac-
ceptable to the City Manager,
and an Oregon State Police
Open Records criminal his-
tory report, both issued in
the last 30 days,” as de-
scribed in Section 8-434(1)(g)
of Ordinance No. 1555.
This information must
also be provided to the state
when applying for a license
from the OLCC, which is
what Andrade took issue
with when speaking to the
council.
According to Andrade, it
costs thousands of dollars to
have this information
processed, a serious cost to
businesses that she believes
the council did not consider
when passing the ordinance
in December.
“It just seems like nobody
is doing their job when they
… look into what we al-
ready have to do and what
we’re required to do, and
how secure that informa-
tion is already held,” said
Andrade.
Andrade explained that
this information is required
by the state to ensure that
business investors aren’t
part of crime organizations,
such as drug cartels, and
that the businesses are not
employing felons, particu-
larly those with drug-related
charges.
After Andrade answered a
number of clarifying ques-
tions from council mem-
bers, the council agreed to
reconsider the ordinance.
The council did not speci-
fy when they would rework
the ordinance and did not
hold an executive session
following the meeting.
The next Independence
City Council meeting will be
on Aug. 29 because of the
high traffic expected in the
wake of the eclipse.
Fire: Firefighters attempted to rescue boy

Two firefighters were in-
jured in the attempts to res-
cue the 11-month-old boy,
Sebastian, and to put out the
fire. Both firefighters were
treated for their injuries,
Olson said.
“One has already returned
to work, and the other should
be back to work this week-
end,” Olson said Monday.
Two members of the Polk
No. 1 board of directors
asked Chief Ben Stange at
Thursday’s board meeting if
there is better equipment
that firefighters need to pro-
tect them from burns in the
future.
Stange said all equipment
meets industry standard.
“It’s just a hazard of close
proximity to a lot of heat,” he
said.
Stange said the mental
health injuries sustained
from this event were in a way
more difficult than the burns
suffered.
“Chaplain Steve Brodehl,
who is the chaplain for the
Hillsboro fire — he’s a very
revered chaplain — he came
down last night and did the
defusing with our folks,”
Stange said. “I’m pretty sure
we had 100 percent of our
folks come. Monmouth police
officers were invited as well.”
The employee assistance
program was extended to all
volunteer firefighters,
Stange said.
“That’s money well spent,”
he said. “I’ve had a chance to
talk to everyone who was on
scene, and it was a really diffi-
cult scene.”
The Oregon State Fire
Marshal’s Office and Mon-
mouth police are assisting in
the investigation.
Dallas Fire & EMS, SW Polk
RFPD, Salem Fire, Independ-
ence police and Polk County
Sheriff’s Office also assisted.
The structure and contents
are a complete loss, estimat-
ed at $200,000, Olson said.
As of Tuesday morning’s
press time, a gofundme ac-
count, Help for Sebastian’s
Family, had garnered $7,605
in donations for the family.

Gator stolen in FC
recovered in town

FALLS CITY — The John
Deere Gator stolen from
the Falls City water treat-
ment plant has been found,
but the search is on for sus-
pects in the theft.
The small utility vehicle
belonged to the Falls City
Public Works Department
and was mainly used at the
plant.
Mayor Terry Ungricht
told the Falls City City
Council Thursday that it
had been stolen. He said
the vehicle was uninsured
at the time of its disappear-
ance on Aug. 4.
Ungricht said he and
public works staff searched
for it, with no luck, and re-
ported it stolen to the Polk
County Sheriff’s Office.
Falls City resident Mike
McConnell posted the theft
on Facebook in hopes of
generating tips.
“Someone claims they
saw it coming out of the
upper cemetery (Thursday)
at 2 a.m., so we are hoping
it’s still in town,” Ungricht
said.
He said the Gator is a
“very critical piece of
equipment,” used to clean

sand filters at the plant.
“It will have to be re-
placed,” Ungricht said. “We
are looking at the cost of
$15,000.”
That won’t be necessary.
Ungricht said Tuesday the
Gator has been found.
“We found it, missing a
hood and was partially re-
painted, but still operates
good,” Ungricht said.
Sheriff Mark Garton said
the vehicle was found on
Friday night on Sample
Road in Falls City.
“It looks like a neighbor
saw it driving, saw some on
it and reported it,” he said.
By the time deputies ar-
rived, the Gator was there,
but the driver wasn’t.
“We looked around in
the barn nearby and didn’t
find anybody,” Garton said.
“The case is still open. I’m
sure we will hear some-
thing.”
