NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN
that the City of Monmouth City
Council will hold a public hear-
ing on Tuesday, October 18,
2016, at 7:00 p.m. at the Mon-
mouth City Council Chambers,
144 S. Warren Street, to con-
sider:
An appeal of Planning Com-
mission approval of Planned
Unit Development 16-01/Subdi-
vision 15-03. Planned Unit De-
velopment (PUD) 16-01 would
amend the approved outline
plan for the Edwards Addition
PUD. The amendment would
change the planned use of an
approximately 8.1-acre area of
the PUD from: "Site reserved
for charter school, neighbor-
hood elementary school, as-
sisted living facility or other
appropriate use" to "Residen-
tial".
Subdivision, (SUB) 15-03
would allow a 22-lot subdivi-
sion, known as Edwards Addi-
tion Phase 7, on a portion of
the newly-designated residen-
tial area.
The property is
zoned Mixed Density Residen-
tial (MX). The property is iden-
tified as Assessor Map Num-
ber 8430, Tax Lot 1100. The
property is approximately
23.95 acres in size and would
be subdivided into the 22-lot
subdivision with an approxi-
mate 19.63-acre remainder
tract.
The Planning Commission
decision has been appealed as
provided by Monmouth City
Code (MCC) Section 18.10.090.
Notice of the public hearing is
provided as required by Sec-
tion 18.10.255 (4).
The relevant standards and
criteria are found in the MCC
Chapter 17.30 Planned Unit
Development, Chapter 17.05
Subdivisions and Partitions,
and Chapter 18.65 Mixed Den-
sity Residential (MX) Zone.
The City Council will con-
sider testimony which address
the applicable criteria listed.
The public hearing will be con-
ducted in a manner, which per-
mits testimony from the appli-
cant and other interested par-
ties. Any person desiring to
speak either for or against the
proposal may do so in person
or by authorized representa-
tive at the public hearing. In
addition, written comments
may be submitted prior to the
hearing with the City Recorder
at City Hall. Written comments
submitted to the City of Mon-
mouth prior to the hearing
date will be included in the
staff report. The staff report
will be available at the Mon-
mouth City Hall at least seven
(7) days prior to the hearing.
The documents and evidence
submitted by the applicant,
copies of the applicable crite-
ria and the staff report are
available for inspection at no
cost and copies will be provid-
ed at reasonable cost.

PUBLIC NOTICE FOR A
CATAGORICAL EXCLUSION
The Oregon Health Authori-
ty - Drinking Water Services
has determined that the pro-
posed drinking water "Reser-
voir No. 1 Improvements" for
the Buell-Red Prairie Water
District conform to the criteria
and requirements of Oregon
Administrative Rules 333-061-
0063 and the supporting guid-
ance manual, "Environmental
Review Process Handbook".
The project involves expand-
ing the capacity of the Water
District's Distribution System
by the construction of a
150,000-gallon "finished drink-
ing water storage reservoir". It
will be located at the Water
Districts' existing reservoir
site, off of Gooseneck Creek
Road. It is therefore categori-
cally excluded from further en-
vironmental review as allowed
in the above referenced rule. A

ment, 1717 Fabry Road, S. E.,

concerning the timber, the
conditions of sale and submis-
sion of bids, including ap-

waive technical defects in this
advertisement and to reject

States reserves the right to
waive any informality in bids
received whenever such waiv-
er is in the interest of the Unit-
ed States. This sale notice, first
published on September 28,
2016, constitutes the decision
document for purposes of
protests and appeals, under 43
CFR Subpart 5003 - Adminis-
trative Remedies. Protests of
any sale listed below must be
filed in writing within 15 days
after the first publication of
this notice. The regulations do
not authorize the acceptance
of protests in any form other
than a signed, written hard
copy that is delivered to the
physical address of the adver-
tising BLM office. As such the
original signed protest must
be received by the close of
business 4:30 p.m. Pacific
Time on the 15th day of the
protest period. This timber sale
is in conformance with the
Salem District 1995 Resource
Management Plan, as amend-
ed. The Cedar Ridge project is
consistent with court orders
relating to the Survey and
Manage mitigation measure of
the Northwest Forest Plan, as
incorporated into the Salem
District Resource Management
Plan, including Judge Pech-
man's Order from October 11,
2006, stipulating four exemp-
tions. This project meets one
of the specified exemptions.
